    Cobalt was not a UK based airline and, assuming you booked online directly with the airline, it has nothing whatsoever to do with the CAA. If on the other hand you booked through a UK agent and received an ATOL Certificate, you may have a claim but I assume that is not the case.

    We then come back to what type of card you used to buy the tickets. If it was a credit card section 75 entitled you to claim the consequential losses, in other words, the cost of getting home, not just the original payment, although you will have to find a way to justify the very high cost of doing so. If you used a debit card, then s.75 does not apply and the most you can claim is the amount charged to the card in the first place, through a voluntary system called chargeback

    We grabbed the first flight we could for me, my wife and my daughter. We had to do a hop to athens and then to LHR. It was a lastminute flight to get home so the costs no doubt were high that way. I think we were panicking to get home and we just found the first flights we could to get back. I do feel a bit cheated by my insurance company who were of absolutely no help.

    I realise the CAA cannot help, but I wanted to do the full due diligence, gather all the evidence of all the airlines, authorities, CAB, etc... just to exhaust every avenue. I was tempted to go down the no-win no-fee route, but again this feels like a bit of a time wasting journey.

    What annoys me is that they said we weren't on the passenger list (we were) I showed them our tickets/reservation - since then I've had radio silence from all those involved since the press release.

    It was done on a credit card (fortunately) - so will explore doing another section 75 - I've got nothing to lose I guess. Can you help advise what clause or part of section 75 I can cite to help my claim? Nationwide were great with the original claim. To be honest even if I got back 50-75% of it I can absorb the rest. IT's the principle of it more than anything that I'm frustrated about.

    @claire - sorry to hear you were stuck in this frustrating situation. I may write to my friends in the press to create a bit of a storm, it won't really help me, but it might make me feel better.

    Scroll down to the bottom of this page, look at the second bullet point and click on the “section 75” link.
  • Well I've filled in a section 75. With time stamped, itemised, and listed and cross referenced evidence.

    I'll see what they say. Next step I guess is small claims court? I know they don't legally have to pay, but I'm sure there's some loophole or something that can be leveraged.
