CEL Court Claim- Defence statement help needed
Comments
-
Can you advise if the statement I have written would be ok to send in?
I wouldn't advise doing that. For a start, the heading should be 'Defence' not 'Defence Statement'.
You said in an earlier post that you didn't know what you were doing. So if you get into court, and Judge says "So, Mr Loz, can you explain to me how the arguments in your Defence relate in any way to what actually happened on the day you received this parking charge? And were you, in fact, driving at the time?", how are you going to answer that.
It's no good chucking a load of template stuff in, and thinking "That all sounds a bit legal, I'll use that", without understanding what you are writing.
The two things a Judge will look for in a Defence are clarity and conciseness. Yours says absolutely nothing about what happened on the day, but the document should start off with that. The rest of it looks like what it is, a template cribbed from online sources. You need to make it more bespoke, more relevant, and much shorter.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0
