Have you contacted VIVID directly and asked them rather than the scaffolder company?
Any letter as per the previous post would bave gone to the address as they wouldnt know you rent it out. So its possible your then tenants failed to object and therefore permission assumed (if worded that unless they heard otherwise they would go ahead)
You could however ask for a copy. What timescale have the HA given you for works to be carried out when you called them?
Seems a bit extreme getting a solicitor involved if you havent spoken to the HA who may be able to resolve this quite quickly?0 -
It's quite possible that a letter to the address from the council requesting permission that wasn't addressed specifically to the tenants ended up in the bin without being opened.
So they went ahead without permission?
Or they assumed that silence meant consent?0 -

Getting the scaffolding immediately removed might not solve the issue from the buyer's point of view - as presumably it just means it'll be back at a later date when the HA are actually ready to do the work.0

All this talk of solicitors and injunctions and trespass and charging them etc.
Many, if not most, deeds have easements allowing access to neighbouring properties for maintenance. Firstly, you need to check that. The paperwork is all with your solicitor so you can ask them to interpret the deeds.
Then, it's always a good idea to speak to the correct people like human beings in a manner that you would like to be treated yourself, which for me personally is in a way that would be most likely to achieve a positive result. That may simply be some reassurance to your buyer that the council are being responsible and that it will be taken down at some point.
It wouldn't suprise me at all, with it being the council, if they have an easement and had also sent a letter to the house informing (your tenant).
It is your buyer's prerogative to delay exchange or pull out for whatever reason they like. This is not the worst case scenario, although the timing of it is unfortunate, this is what landlords have to contend with.Everything that is supposed to be in heaven is already here on earth.

but it is a terraced house so it does go onto our roof
Does this give easy access to you upstairs windows for a burglar?
I did see a thread on here (probably insurance board) where someone had an insurance claim denied as burglar got in upstairs via scaffolding.0
