Smart Parking Fine - LBS Newark On Trent

I was wondering if someone could please offer a little guidance/reassurance on the actions that I've taken against a PCN received by Smart Parking.

The parking charge notice was received by Smart Parking Ltd, after my dad hired a van to go fishing with. He parked on LBS Car Park, Newark on Trent and paid £2 for 14 hours, of which he was there no longer than an hour and a half. The letter we received has photographs of the vehicle entry and exit times which also state this.

Unfortunately, we live nowhere near Newark and so it's not possible for me to go and check the signage and my dad, not thinking it would be necessary, did not keep his ticket for proof of payment. He says he paid with £2 cash and so bank statements would also be no use to this appeal.

After reading numerous threads, including the newbie first post, I have copied the template

Re PCN number:

I dispute your 'parking charge', as the hirer of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

I have since submitted this to Smart Parking's online appeals page and now I am suddenly doubting as to whether these were the correct steps to take with the appeal regarding a hire van, no parking ticket and being unable to physically check the carpark out myself due to the distance.

I hope this makes sense and that my reason for posting is not deemed stupid.

I am here for help and reassurance in order to help my dad so all constructive feedback is most appreciated.
