So I went to a town Id never been to before to attend a chemotherapy group. On entering the multi story car park I didnt see any barrier or ticket machine and like a lot of car parks nowadays thought it was anpr. Sat in car for a few minutes to get my bearings of where I needed to go and looked around, could not see signs nor ticket machine. I looked at 2 cars next to me snd neither had a ticket.
Left the car park and there was a machine with a keypad so thought again its anpr.
Finished my group and returned, put in number plate and waited to see what i owed, nothing came up so I put £2 in which was 2-4 hours and a ticket was issued.
Couple of weeks later, fine in the post asking for £100. Logged into their site and its asking for £60. I filled in appeal stating ive never used a multi story you pay for first and that I had actually paid albeit on exit and sent copy of the ticker.
Had another letter stating about their terms and conditions, claiming theres clear signage, which I disagree with. What multi story do you ever pay for in advance? I cannot think of a single one snd ive used plenty.
Theyve sent the standard appeals blurb whereas im of the view their signage is confusing, inadequate, and I did actually pay for the time I was in there?

Does the 2nd letter you have received have a POPLA code in it somewhere?
Excel are IPC AOS members, not BPA AOS members, so a PoPLA code will not have been issued.
OP, not sure what your question is, but there is nothing to be done now other than prepare yourself for a barrage of Debt Collectors letters. Post #4 of the NEWBIES FAQ sticky thread will guide you through that.
Post again on this thread if ever you receive either a Letter of Claim or official court correspondence and you need further help.0 -
Appeals are to IAS. Question was whether there was anything i could do about it? I dont recall signs saying to get a ticket, I looked. I also looked at cars parked next to me, they didnt have a ticket either. They were probably also ladies from the chemo group as its only the 2nd time the venue has been used.
I have never in my life used a multi story you pay on entry! Even going back to my mum taking us shopping in the 70s was always on exit!0 -
fair comment but unless you can get the landowner or EXCEL or the IAS to cancel it you are stuck with it, like it or not, for 6 years
EXCEL have 6 years to take it further by issuing an LBC or an MCOL

and yes most car parks of that design are pay on exit, so tell the judge !! lol
I was in a hospital car park (not a multi storey) last saturday and it was pay on exit, whereby you take your entry ticket to the pay booth near the exit and pay, then get out of the car park promptly0
