Toyota Claim under Plevin

I wanted to ask: Back in 2004 I had a financial agreement with Toyota - I put a claim in for PPI through your recommended site Resolve & Toyota have now offered me a refund for an amount referring to just 1 agreement between 2004 & 2006. I have been with Toyota for many years & had further agreements as I still have currently. I called them today to explain that I had 3 other agreements between 2006 & 2011 where I'm sure there was the same protection cover applied. The staff member that is dealing with my complaint said he could only see in that first agreement where I had cover...I asked should I email agreement details & he said he can have another look but he couldn't see any other PPI he said for me to go through private email instead of resolve. Should I accept this offer for the first agreement? & should I treat the other agreements as new separate complaints or should I wait until all are confirmed to fall within the scope of unfair relationship provision set out in the consumer credit act 1974? I only have 19days left to return acceptance form. Many thanks. Trish.

Plevin refunds only apply to credit agreements that were still in force in 2008 or after. If the debt was repaid on the previous ones prior to 2008, then they do not qualify.

Plevin came about because of an amendment to the consumer credit act in 2006, effective 2008. Hence where the 2008 date comes from.

I very much doubt PPI was still available as late as that from your provider, so it's not surprising the complaint handler can't see any policies for those later Agreements.

Plevin only applies to rejected PPI complaints where there was actually a PPI policy.

Any complaints you make about your later Agreements are separate from your recent successful complaint, though, so you can safely accept the redress offered without jeopardising any future complaint.

You also don't need to complain via Resolver.
  • Thank you so much. So I'll send the acceptance form off in the morning
