Universal credit and SDP

Hi everyone,
I'm really hoping that someone with more knowledge than me can answer my question here regarding change of circumstances that would usually prompt a move to UC.
If you remember in June 2018 DWP made an announcement that those currently claiming SDP will not have to move to UC until you qualify for a transitional protection. Since then, i've heard that this won't be put into place until a further announcement has been made sometime this Autumn.
I'm waiting for this announcement because i have to move house and it will give me more choices outside of my current local council (i'm in a full UC area)
As far as i know there's been no further announcements made but having done a search this morning i came across this from the money advice service. Scroll down to "if you're getting the severe disability premium"

The budget is 2 weeks today, I'm hopeful of some major decisions on UC being made but I won't hold my breath.0

The answer to your question is, No, the rule isn't yet in place and the up to date information i've had (from the DWP yesterday,) it's going to be early next year at least, before we hear anything.
You can't put your life on hold for ever? so think very carefully if you are initiating a move whereby you'll lose your SDP. You'll never get it back again in it's present format unless you can find a human rights solicitor who has 'capacity' to take your case to court.
Weigh up the benefits of moving against the loss of the SDP.
When you do get the backdated SDP payments, (and every indication is this will be 80 pounds a month, only,) you're not going to get the 'back' payments of 80 pounds a month, anytime soon.
It's also worth noting (and make sure you do some research beforehand with the LA you are moving to,) you may also be liable for some Council Tax. As UC is a working age benefit and you are no longer 'disabled', it's a double whammy, unless you can follow other routes for Council Tax exemption. Each LA has different criteria.
Even when the government eventually makes back payments of the SDP, you will only receive 80 pounds a month, some 100 pound short of the SDP you were previously receiving.
You are never going to receive what you are currently receiving with ESA and the SDP.
It's also worth noting the amount of 'interaction' (and you do need to have some interaction,) you need to have with JCP, your work coach and your journal, even if it is all online. As you don't get an 'award' letter as previously, I still have to check and print off my monthly payments as 'proof of benefit' which i require for some health appointments.
If you can 'manage' without your SDP and possibly have to pay some Council Tax too, then by all means go ahead and move. But just be aware of the effect this will have on your daily life, (and the effect the stress has on your health,) too.
Take it from one who knows.

Thank you for that information! At the moment i'm just looking for a new home but have no intentions of moving outside of my local council until this new rule is in place. If it means i have to wait longer then so be it, i'm not in any rush. I have no problems staying with my current local council but it just means waiting longer because there's less choice of course. I need to move because my current home is no longer suitable but i can manage as i am for now because i'm not prepared to lose all that money.fredandwilma wrote: »Hi poppy12345

They're discussing on the news now that there's been an announcement they're going to make changes to UC.Unless I say otherwise 'you' means the general you not you specifically.0
