POPLA Appeal. Help needed!

Hi all,

I've appealed as the keeper of the vehicle to Euro Car Parks and had the appeal rejected. I now need to write a POPLA appeal but this is the first time I've ever done this. I'd be really grateful for some pointers or examples of relevant appeals that I could use as a basis for my own appeal.

Below are links to a copy of an e-mail received from ECP after the initial appeal:

Please note, as a new user I can't post links so edit the above to start with https after pasting :)

Thanks in advance!

S.

I won't convert those links for you at the moment as there are identifying details contained. Your Dropbox account seems to be under your real name Bxxxxx Mxxxxx, which shows on the front page of every link opened. In addition, having looked at the first link, your Christian name is showing in the ECP correspondence to you.

So please go through all the documents you are linking and completely cleanse them of any potential personal identifiers.

In terms of POPLA, you need to study carefully the advice given in the NEWBIES FAQ sticky, post #3 which tells you how to win at POPLA, it includes ready to use template (perhaps with minor adaptions to the circumstances of your case) appeal points. There may also be links to recent Euro POPLA appeals - have a look at these and use anything useful (and relevant to your case!).

In addition do forum searches on keywords 'ECP POPLA' or 'Euro POPLA' and look at recent cases (last 3 months or so). Don't use 'Car' or 'Park' in your search keywords or you'll get zillions of irrelevant returned posts.

HOW TO USE THE FORUM SEARCH FUNCTION:

Hit your 'Back' button to get back to the forum thread list. On the bar just above the threads you'll see the 'Search' function. Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The first image still contains the whole PCN number.

ANPR does not capture parking time, only time on site. Driving around looking for a space is not parking.
