Land owner not known

Hi,

I am helping a neighbour with a PCN but want to make sure I have all of the answers as they are a bit of a worrier!

I have read the template on the Newbies thread, however this refers to making a formal complaint to the landowner. However it is not clear who the landowner is, as it is listed purely as a Service Area.

Does this make any difference to the reply they should make or should I recommend sending the template as it is?

Any advice on this appreciated.

They also appear to have been the victim of underhand dating of the PCN. The letter is dated a week after the alleged parking contravention, but was not received until 2 weeks after the letter date!

    Send the template exactly as it is. It's not your job to prove they have landowner authority.

    The date and posting of the letter could be inefficiency on the part of the scammers, or it could have been deliberately backdated. The whole private parking industry is a scam run by cowboys so both are quite likely.

    What is the name of the PPC please?

    Please complain to your MP about this unregulated scam.

    The PPC is Elite Management (Midlands) Ltd.

    I was also wondering if there was a way to find out when they accessed (or received the information from) the DVLA for the owners name and address - if this information was accessible and turned out to be after the date they had put on the letter then I'm sure this could me a fairly big problem for them?

    Ask the DVLA. They have to tell you if you ask.

    As above, ask the DVLA who accessed your personal information between dates either side of the alleged event and receipt of the NTK. Make sure you say you believe this service is free, and include a copy of your V5 with the request.
