Have I missed my returns period?

I bought a pocket phone charger from eBay in May. It seemed to work at first but now struggles to complete a full charge.
I got in touch with the seller a couple of weeks ago via PayPal. He told me to send it back for a refund.
Unfortunately since then I've had a lot of things on, including suffering from depression, plus had to dig the thing out, as I'd mislaid it. So a week or two got wasted.
I got back onto Paypal this afternoon to request the returns address only to discover my return period ends tomorrow; Monday 15th October.
Question: Would it be too late sending the thing back tomorrow as surely by the time the seller receives it the resolution will be shut?
Any ideas?

Did you escalate the case?
As long as you send it back within the timescales and keep your proof of posting and upload your proof of delivery, it will be fine.0 -

I raised a dispute by PayPal (I think that's what you mean by escalating? Please correct me if not so).
So when PayPal says "This problem will automatically close on Monday, 15 October 2018." Does that mean 23:59hrs tomorrow or tonight? If the latter then surely I'm stuffed on a Sunday?
If tomorrow then where do I find the returns address in the case that the seller doesn't get back in time?0 -

No, opening a dispute and escalating one is different.
Did you escalate it?
If you don't know, can you say what happened after you opened the case and what you did then...
It doesn't sound like you have escalated it as you should have been asked to return the item....has that happened?0 -

Looks like I've only done a resolution via Paypal. I don't recall clicking on "esculation" and my account says this: "You may escalate this to a claim on or before Monday, 15 October 2018. If this case hasn't been resolved by Monday, 15 October 2018, it will be closed automatically. You won't be able to re-open this case."
So presumably I haven't. I don't particularly know what the difference the two are to be honest.0 -

No problem, not a lot of people have to get this far.
If you escalate it.
Paypal will then review the details.
Assuming this isn't a guarantee claim, but a 'on first use it didn't work' claim then you will be fine and they will ask you to return it. Although I am not sure from your OP if you made the case clear enough? Only you know. If you need to shore up your case, now would be a good time and then escalate it.
When it's escalated, Paypal will review and make a decision. TBH as the seller seemed to be onside (and if I've read this correctly, you didn't respond.....) then you may ostracise the seller enough to make them abide by the case decision. It may go either way. What would you do if they don't agree it's in your favour?0 -
It "worked" on first use, and still does to a certain extent, as in it charges itself up so far then when I put it in my phone it gives the phone some charge before conking out before the phone is fully charged. Ultimately it's not fit for the purpose.
On my first Paypal resolution message I quoted that it didn't work (as it doesn't properly). On my message earlier today I asked for the returns address (not sure why he didn't offer me that initially) and stated the above. That I've tested it again and it works very briefly before stopping.
Still awaiting his response with the returns address. Assuming he gets back to me by tomorrow morning and I post it off providing proof could I still get a refund after the 15th? Or am I best esculating it now?
If the worst comes to the worst then it's a tenner down the drain
On an aside I noticed the seller has been removed from eBay. Not sure what it was for though.0 -
Just sent this:
I've fully charged the power bank.
I then plugged it into my phone (phone was displaying 12% charge remaining) and the power bank ran flat before the phone reached 50% battery charge.
The power bank was advertised as 10000mAh. My phone only has a 2540mAh size battery. Therefore I should be getting several charges out of the power bank. Instead I'm getting less than half a charge!
This item is not fit for purpose.
Please get in touch.0 -
As you opened the case and cited the reason 'it didn't work' that should be sufficient for you to escalate and win the case.
If you do not escalate the case you will have no means via Paypal to get your money back. I would suggest you escalate the case to protect your money.0
