Drink driver hit my parked car. They were insured mine wasn’t (between insurers) what do I do?

  • Sorry one last question. Rung them and let them know all the details, they are contacting me back tommorow. I obviously will have to wait for them to contact me back to sort anything with my car now? Or should I take it to a garage?

    Take it to a garage authorised by whom?
    It's not insured you posted earlier.

    If you're letting them sort it out, then let them sort it out. Don't complicate things.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    This happened to a friend of mine.

    He hit a parked car (not drunk, just not concentrating and this car was badly parked) and discovered the parked car was uninsured.

    His insurance still had to pay out, but he then reported this person for having an uninsured car on the road as it is now a legal matter since 2011.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    Before 2011 it was a bit of a grey area because the only offence was "using" without insurance. There was case law to support that having it parked on road might amount to "using", but there was also case law supporting that it didn't in some cases.

    The continuous insurance rules made "keeping" an offence in its own right, but with lesser penalties than using - fixed penalty or fine, no points for keeping instead of fine + points + potential disqualification for using.

    Have you informed your insurance company about the incident? even though it was from before the policy started I *think* they will still need to know about any claims in progress as it will impact your risk levels.
  • Yes thanks. I have already informed them too. There insurance is contacting me tommorow to let me know what happens next.
