    After reading some of posts online, I start to doubt whether I can win the case. They originally asked for £60 per ticket X2 and now over 450 in total.

    That is their intention, to scare you into paying sums which the law does not allow. The down market solicitors whom the PPCs engage know this, but, because they are solicitors, know that a lot of people will pay up.

    It is in fact double charging and non claimable debt collectors' add ons. Imo, this is fraud, or, at the very least, improper conduct.

    Were this to get to court and win, the judge would be unlikely to award the claimant more than £175 - £200.

    I urge you to report this grubby law firm to their regulatory body, the SRA.

    Has the solicitor made reference to Beavis? If not, there is no need to mention it. If they have, if this PCN was issued for parking at a residential complex it has nothing to do with the case. Have you read this?

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.

    But it is a good rant, the sort of thing that a member of the public might write, and very probably true.

    I think that it may be well received by a judge who is all to aware aware of the proclivity of these down market law firm to waste court time and the scam industry they are supporting.

    After reading some of posts online, I start to doubt whether I can win the case. They originally asked for £60 per ticket X2 and now over 450 in total. However, given the time that I put in this, it does not worth it at all and I might lose anyway.
    But where is 'online'? People's unsupported, weaker defence experiences off this forum?

    We see wins reported here 99% of the time! Why not search the forum for:

    ANOTHER ONE BITES THE DUST

    ...and read all the reported wins - sit down with a cuppa and do that search & read them!

    And even if a person loses, for two PCNs, the Judge would not award over £275 approx (no CCJ, no risk). And that is rare on here.

    Of course you can plan to win, like almost everyone does. :)

    That is their MO, fear, threats, and lies. In your circumstances, I would venture that, if they are daft enough to take this to court, they could come a huge cropper.

  • Hi Everyone, can you help with my situation? Following the case mentioned here, I was asked to attend a court hearing in late July. I was out of the country for work and thus sent them letter for absence - I think the Claimant's lawyer also asked for absence. I was expecting a court decision in regards to my parking ticket, however, I have not received anything until now - it has been more than 3 months. Is this normal? Shall I do anything? Advices will be greatly appreciated!
