According to my calculations the overstay is Ten Minutes and Twenty Five Seconds.
With reference to Toby if I was in their shows I would have refused to answer your tlephone request. Put it in writing sent recorded delivery, might even enclose a SAE. A note explaining the reason for your asking might elicit more sympathy. Again if I was in the managers position then I would be more inclined to assist with uch an approach.0 -

Your maths is slightly over optimistic. From passing in front of the ANPR camera on entry & again on exit was 40 minutes 25 seconds. However I still contend that no contravention occurred as the CoP mandates a minimum of 10 minutes & that the car was not parked for 40 minutes 25 seconds.0 -

ANPR records time on site & does not record the time from acceptance of the parking contract to departure.13 Grace periods
13.1 If a driver is parking without your permission, or at locations where parking is not normally permitted they must have the chance to read the terms and conditions before they enter into the ‘parking contract’ with you. If, having had that opportunity, they decide not to park but choose to leave the car park, you must provide them with a reasonable grace period to leave, as they will not be bound by your parking contract.
13.2 If the parking location is one where parking is normally permitted, you must allow the driver a reasonable grace period in addition to the parking event before enforcement action is taken. In such instances the grace period must be a minimum of 10 minutes.
13.2.a Vehicles are not permitted to park under the grace period in spaces designated to specific users for example Blue Badge holders. At all times vehicles must have appropriate and valid permit e.g Blue Badge on display for enforcement officer to inspect.
13.3 You must tell us the specific grace period at a site if our compliance team or our agents ask what it is.
13.4 You should allow the driver a reasonable period to leave the private car park after the parking contract has ended, before you take enforcement action. If the location is one where parking is normally permitted, the Grace Period at the end of the parking period should be a minimum of 10 minutes.0 -

If this were me though, I would fill in the simple form on ParkingEye's Privacy page right now, this week (no delaying) and require their Data Protection Officer to provide all the raw images taken by the exit camera that include your car/VRN in shot, because there was a delay caused by a delivery lorry and you need to see all the images that you understand are captured about once a second.
Tell them this is a SAR (subject access request) and to email the images that contain your car/VRN at the exit, and these must be uncropped and not re-touched or altered except to only redact any other vehicle's VRN or faces/similar identifying images of passing individuals.
Don't write the above as another appeal, it;s exactly what I said, a SAR, a request for all photo data.

Your first priority is to get your POPLA appeal in by its deadline date. If the SAR is late arriving, that should not delay your POPLA appeal, although you can leave it until near the deadline, provided you don't miss it. You get around 32 days (not the 28 days shown on the POPLA website) to submit.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Parking Eye of late has been ignoring grace periods and
it's their "not accurate" ANPR every time
YES, you do have a grace period and that must include
being unable to exit the car park
Have a word with Toby and find out their delivery times
then appeal to PE and highlight the grace period and
the obstruction.
If PE fail to observe the grace period then you must
complain to the BPA for investigation
