In arrears, what to do

  • I know what you mean, but I've just had enough. I just want to cut my losses and leave.

    They have known my situation from the day I collected my keys, and I have stayed in touch with the EA since before I had payment difficulties explaining the situation and my payment plan. They completely ignored me and (it seems) didn't communicate with the LL until he contacted them (they advised to email them not the LL as I pay my rent to them, up until then I had contacted them both).

    I just don't want my life to be made awkward by the EA, so I think the best thing is to just go!

    Comms69, at this stage, they have said that is my only option. - no its not! Legally their recourse is to serve a Section 8 notice and go to court, by which time you will have cleared the arrears and the court will say you can stay. You have a binding tenancy, you don't have to discus iwht the LL or ask their permission to stay. I can afford to clear the rent arrears at the end of October if I'm not paying rent, and can stay with friend for a month or two until I can rent somewhere else. - up to you if you have somewhere to stay rent free and that saves you money, but how long will your friend be so generous? I'd rather save that for when I really need it.. right now you can afford to stay put and have the legal right to..

    It is only costing me the additional £150, so if it means I can leave and just be done with it all then fair enough, I'll accept that.

    Getting rid of the furniture while I'm working is going to be tricky, but I'll try.. - don't forget that if the next place is unfurnished, you'll need to buy everything again, getting minimal £ if you sell your current furniture, or pay for storage and 2 lots f delivery. Do you think they'll mind if I leave the fridge freezer?!! - we can't possibly know.. they might want to keep the fridge if it is in good condition, fits in the space and the next tenant doesn't bring their own, but legally they can charge you the cost of disposal for any items you leave behind.

    Sorry to shout, but you don't seem to be listening. YOU DON'T HAVE TO LEAVE. If you would choose to leave regardless then fine, but sounds like you're only thinking of it because of the pressure from LL / LA. Legally you can stay, pay off the arrears before they reach 2 months and no one can make you leave.
  • I totally understand what you are all saying, but this whole thing has left a real sour taste in my mouth, and I'm not happy to stay.

    The house is overpriced anyway so the EA and LL will have it on the market for a while. I just think the way they have treated me is quite bad. I know I am in the wrong, but I have stayed in contact with them and kept them up to date the full way through. I know neither of them need to care about me, but I just find it all a bit hard to swallow.

    I am paying for a room where I am moving to, so will be able to save and won't be putting anybody out. I am actually considering moving 'home' instead of staying up here, given everything!
