Void car insurance - pls help?

    OK, so a quick look for Aviva's Ts and Cs for telematics found this - I don't know whether you bought through this broker or direct or what, but I doubt there's a significant difference.

    So the key points...
    * 50%+ above the speed limit = cancellation.
    * Driving information is recorded against policyholder not "alleged driver".
    * Score of -6 to -10 = "high risk", 4x "high risk" in 30 days = cancellation. (2x = monitoring, potential extra premium. 3x = £100 penalty, failure to pay = cancellation).


    It's all very clear, and named drivers are explicitly the policyholder's responsibility.

    Hopefully they didn't actually word it that way. ;)

    (It's a contractual charge, not a penalty .. an insurance company has no lawful authority to apply a penalty). :)

    We have a MoreThan SmartWheels black box and the rules are similar.

    I did think that if we got a cancellation notice we would cancel ourselves as my 18 year old son would be saddled with the potential burden of a cancelled policy for a long time as the question is usually 'have you EVER had insurance cancelled'

    How long have you had the policy?

    Well a penalty definition is
    a punishment imposed for breaking a law, rule, or contract.

    And an insurance policy is a contract.

    However it depends on whether OP got the Aviva scheme direct or through another Insurer/Broker and Aviva is just the ultimate insurer as Aviva have a few telematics schemes floating around.

    So, was he doing 45 mph in a 30mph limit, or 105mph in a 70mph limit?

    a punishment imposed for breaking a law, rule, or contract.

    Definition from where?

    Under UK contract law it is not permissible for a company to apply penalty terms on a consumer, and I don't believe insurance contracts are excluded from this. (Business to business is a different matter)

    I would ask exactly where the incident happened and check if the data is correct , these telematics have a habbit of recording duff data , i know as my work vehicle has telematics and its often wrong and have proved this myself many times eg saying its a 20 zone when its actually a 40 so that's twice the speed limit

    Another thing where it can cause wrong data is going down a dual carriageway which is 70 but has a side road running alongside which is a 30 for example it thinks you are on the 30 road not the dual carriageway
