Obviously more than 3 years have passed, but I never received the letter as they sent it to an address that I moved out of in February 2012. I have told them I was the compliant reconsidered but they are not being very forthcoming and are now asking for proof of the address I was at in 2013. All I have from then is a bank statement with my address on which I have sent them.
Has anyone else been in this situation and have they had the decision reversed without having to go to the Ombudsman?

If your address was different you can go to the FOS and ask them to overrule the timebar - just provide proof of the change e.g. the record from the council showing your change / length of time from credit agency or similar bills from the period.

I have 2 PPI complaints in with MBNA and they have sent me a letter saying the reject my complaints based on the fact they wrote to me in June 2013 to bring them to my attention and apparently the letter said I had to get back to the and make a claim within 3 years.
MBNA are one of the known companies that did issue CCLs. So, that response is not unexpected.Has anyone else been in this situation and have they had the decision reversed without having to go to the Ombudsman?
The FOS is inconsistent on this. There are decisions that have ruled both ways. However, in most cases, if the account was closed before you moved address, then you would expect the FOS to open the timebar.
However, do not that MBNA are not saying they will not allow it. They are just asking for evidence of change of address. Do you have evidence that you informed MBNA of your new address?
