County Court Claim for Parking Control Managment UK

  • Hi Everyone,

I need to file my defence today.

So far I know I need to get in my defence that I was parked outside the gates to the area which has signs about parking. I also know I need to put that we were unloading the vehicle as we were moving our business. So would this be ok for putting in my defence -

A defence is being put forward due to the fact that the vehicle in question was parked outside the gates of the area that had restrictions on parking, loading/unloading. There is reasonable cause to believe that if the vehicle was subject to a fine in that area, preditory or misleading practices are being enforced. The singage and markings were so misleading that they didn't meet the minimum standards of forming a controlled zone.

Futhermore, the vehicle was not parked but in fact unloading. The vehicle was hired to move a business during the Christmas break and was situated as close the the new building as possible without blocking traffic in the safest place. There was no obstruction into the restricted area and witness statements can be provided from 4 individuals that were employed to unload the vehicle.

OK, ring the CCBC in the morning to make sure the email is logged on MCOL as defended, urgently. People have had CCJs for not making sure they beat the Claimant to that stage, by ringing the CCBC and pushing for them to deal with it on the spot.

And then read the WHAT HAPPENS WHEN section by bargepole in the NEWBIES thread post #2.
