PPS charge notice

intentionallydeceived
I have read the newbies thread and still have just so many questions
a Parking charge notice (pps ltd) was stuck to window 2 weeks ago.
the signage on the entrance was and still is partially obscured by over grown ivy the only other signage visible is 9 foot in the air, not obvious and the text is to small to realistically read when stood underneath it let alone readable from inside my car. also it has the bit about how much the "fine" is in tall squashed font making it even more confusing and more importantly difficult if not impossible to read. the amount they claim is now owed is £100 or £60 if paid in 2weeks.
if i appeal and its rejected do i pay £100 or £60? if it goes to court can i really be charged upwards of £400?
if i follow the advise given in the newbie thread i am to wait till day 28 to make an appeal (ipc member) but their website and paper work says i must appeal in the inside of 21 days???
how long does this process take? it says on their website it can take 28 days to get an answer and from what i have read that will almost certainly be a no as they make you jump through as many hoops as possible to get it dropped.
I cannot express in words just how stressed this has made me. for the past 2 weeks this has been all i can think about i have genuinely lost sleep over this.
i cannot afford to pay either amount i really do live to my budget. im not even kidding about this. if i have to pay food really will come off my table.
my partner has gotten sick of me talking about it and it is causing problems at home. but there is no one i can talk to about this.
friend i have talked to tell me to "just pay it and move on" someone has offered to pay it for me but its also the principle of being exploited. can i pay now and then still appeal?
sorry for the rant

You can talk to us, but first read the stickies/FAQs about it and watch the video below, It can take months, even years, but is is only an invoice for an alleged breach of contract, it really is not worth getting stressed about.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
Edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people.
Edit your post before you do anything else. Parking scammers read these fora.
Next, re-read the NEWBIES, wait for the NTK like the NEWBIES tells you, then send the template appeal from The Keeper exactly as it is.
You do not have to pay anything unless a judge says so. The parking company's rejection is not binding on the motorist.
The maximum if you lost at court would be about £175. Most PCNs are winnable in court if defended properly.
So, read, wait for the NTK, appeal, ignore anything after that except real court papers.
Ignore debt collectors, post 4 of the NEWBIES explains why it is safe to do so.
Please also complain to your MP about this unregulated scam.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Thank you for replying... everyone that has...
what makes me fearful is "Most PCNs are winnable in court if defended properly." its the "most" and "defended properly" bits that concern me. i have little to zero knowledge of legal speak, acts or anything else to do with the law, although i do understand that only a court can enforce payment. i have no idea how to myself properly in court and i simply do not have time to deal with this.
so once i get the NTK through the post i then appeal through the same online form available to me now (on the PPS ltd website)
what about the bit that says the driver must appeal within 21 days?
if it is payed on my behalf can i still go through the appeals prosess? i say this as others have photod the ticket received and may well pay without my consent. for some reason some feel the issue is entirely the amount of money and it is in part but its also the principle
I really am so very grateful forums like.0 -
It is all a scam, the appeal process is rigged. Unfortunately it is not unlawful so the choice is pay or fight. complain to your MP.

What about it? That's only for The Driver, who should not be identified. (You should edit your post accordingly). If The Driver doesn't pass it to The Keeper then how can The Keeper appeal at all, let alone within 21 days. The Keeper may not know anything about the NTK if The Driver hasn't told them.
For all The Keeper knows the NTK could have been removed by some rogue, or blown off, or never been attached in the first place, or put on, photographed by the PPC operator and then removed.
Wait for the NTK, then The Keeper appeals using the template within the timescales given on the NTK, by whatever method it says on the NTK.
There is a step by step guide to court in the NEWBIRS. If you can set up a mobile 'phone or follow a recipe you can probably follow it. Court is a man or woman in business clothes (the judge), and you and the scammer's representative in a room about the size of your living room probably.
You would be helped with the process by the regulars on here.
If you don't want "others" to pay this, you make it known. Also make it known that if they do, you won't be giving them any money for denying you the option to appeal.
Please do complain to your MP as advised above. It really is the only way to get this scam stopped.
Our MPs have called these people scammers and cowboys amongst other things in open parliament, so get them to work for their money on your behalf.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Hey
Just an update, written to MP, received the NTK last Saturday. Fairly sure its a template, i do not really understand it so i cannot conclude if it is inline with the POFA or not. (PPC is an IPC member so not sure if that applies?) its written using intentionally complicated wordings. however it does make clear that i will be liable if i do not identify the driver (funny how that bit is perfectly clear isn it) is it worth posting here or does it simply not matter? have not sent the template off yet is there a best time to do this inside of the 28 days.0
