Apparently I've been on a 2017 thread and was redirected to the newbies page because it was out of date but this Newbies page was written in 2014.

The date of the most recent edit is on every post in the thread!
  • I have a question regarding the "Template appeal for BPA or IPC members - copy this wording into the online appeal box". In this template it states:

"Service of any rejection letter/POPLA code and/or legal documents by email is expressly disallowed. All responses to me from this point on, must be made by post. Regardless of any MCOL online/email system, service of any court claim must only be made by first class post to the latest address provided by me."

To appeal to UK Car Park Management via the IPA appeal website (only way it says to appeal a ticket, on the back of the PCN), when I enter the PCN reference and my veg, a pop up box says:

"If the details you have entered are correct, your appeal will be started. Please be aware that continuing past this point will disable you from entering a postal appeal and your appeal MUST be continued through the online service."

If I continue, will the fact that I've said I will not respond to anything other than post, still remain? Or will they just email me back and say "well we said we weren't going to reply postal and you agreed to this"?

    Just a question. p.S I'm just about to appeal a PCN (non-windowscreen).

Stop thinking that minor comment on the template appeal actually carries any weight; it's just thrown in there to try to encourage a letter as a reply, not an email that might be missed. It means nothing much - I added it to stop PPCs thinking they might in future serve court claims by email (which the Courts have apparently decided would be a good idea in future!).

Leave it in but it's only an exercise (dispute is better than ignore) and there is no appeal that works:

See you at court claim stage when you will need a new thread, to defend the scam.

Thanks Coupon! Much appreciated! Didn't know they reject all appeals.
Secondly, the offence took place on 18/09/2018. They didn't issue this PCN until 03/10/2018 and I didn't receive the letter until today (Saturday 06/10/2018).

I believe a response simply stating:
"I acknowledge receipt of your letter reference {hidden] which arrived on 06/10/2018.
I am the keeper of vehicle [hidden] which is the subject of Charge Notice [hidden]. The notice fails to comply with paragraph 9 of schedule 4 of the Protection of freedoms act 2012 namely, but not limited to, failing to deliver within 14 days.
I, as the keeper, cannot be held liable for the actions of the driver on that occasion. I have no legal requirement to identify the driver and will not be doing so, I do not expect to hear from you again about this matter, which will save you a response telling me that all further action is cancelled.
    Kind regards,

Would this reply be sufficient enough or is it better to simply go with the template? You would think as it's more than 14 days they wouldn't even try following through. You must have come across this situ before!

    P.s you're a godsend! A blessing!

Yes that alternative letter would be fine (except I would never put 'kind regards' to ex-clamper thugs).

Your appeal makes no difference & won't stop them. Do not try IAS.

The FB page is at least 10 years behind the curve.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
