When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to [EMAIL="CCBCAQ@Justice.gov.uk"]CCBCAQ@Justice.gov.uk[/EMAIL]
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
yes, post #2 of that NEWBIES thread mentioned above has good guidance, with many examples, on how to write a Defence.
Great i will now Go through the process and file defence. I cant believe there are companies still operating like this but if everyone stands up then hopefully will soon be gone.

ok i have a directions questionair.
im not to clear on how im supposed to fill this out so im gonna go through to see if im filling out right.
A1: Do you agree to this case being reffered to mediations? No ( i want this to go court right?)
B: Fill out my contact details
C1: Do you agree small claims track is the appropriate track for this case? Yes
D1: At Which county Claim court would i prefer the small claims hearing to take place and why?
Im going to give details of closest county claim court near me and the reason is " because its close to me"
D2: Are you asking the courts permission to use the written evidence of an expert? No
D3: How many witnesses including yourself will be giving evidence on your behalf? 0
D4: Are there any days within next six months when you , an expert, or a witness will not be able to attend? No
Will you be using an interpreter at the hearing either for yourself or for a witness? "My father is actually the defendant he can't speak english so will i be able to go and translate for him.if so im assuming i would i put my name in this section????
Then i sign the questionair and send to the courth office address shown

Hi Guys
Just a quick Update, we had court hearing dispite being told off for not filing a witness statement by the judge case still got dismissed as the claiment didnt file one either nor did they bother showing up. so the judge spent most of all 5 minutes in the room basically having a go at me telling me how lucky i was and that i was disobeying court order by not fileing a witness statment. Then basically telling me to get out of her court room.
So good result.
Just wanted to ask
1. Am i write in saying its to late to claim for travel cost etc and that i should of put a claim form in prior a day before the case.
2. also i read the notice of allocation that was sent and it mentions what a witness statement should have in it but doesnt actually mention how to file the witness statement and by when does it get filed.
(just wanted to know incase i have to go through this again)

Too late to ask for court costs, yes, and it sounds like she'd have told you where to go!
As for the other question, come on, our sticky thread told you about WS stage and how to word it, what evidence to file and who to send it to and when!
Boy, you got lucky.
NEXT TIME for the love of God, read the NEWBIES thread more thoroughly and come back in between - no rocking up and court relying on a defence. OMG how come people do this, despite the court letter telling you about your date to submit your WS and evidence, and despite you being here, when you know all the advice on ALL stages is in the NEWBIES thread?
