Premier Park Ltd - POPLA

Hi all,

I hope you can help. I have had a look at the newbies thread and FAQ’s but wasn’t able to find my answer.

I stayed in a hotel for 2 nights in Dorset and paid for parking around the back of the property. It wasn’t a proper car park eg. No bays and very gravelly and had maybe 4/5 “spaces.”
Hotel said it’s not their land and charged £5 per day for payment to landowners. I purchased and was given a handwritten permit to display.

However, the stupid thing must’ve blown off the dashboard as I received a PCN by a Premier Park Ltd in the post. It was addressed to the keeper of the vehicle (not me) demanding payment for non display. I also threw away the permit after the trip so don’t even have that to show. Hotel refuse to get involved and verify my stay as a guest.

I wrote back to say I would not be disclosing the driver but also sent a cheque for £25 (without prejudice) for the honest mistake.

The have now returned the cheque and have issued a POPLA code.

I later realised that actually the NTK did not arrive until 3 weeks and 5 days after the event but I did not mention this in original letter/appeal with the cheque. Conveniently they have also not dated the letter.

Should I mention this at POPLA stage now or just pay the fine?

It is very stressful just with these few letters and I imagine it will only get worse!

Please can anyone offer me advice. TIA

    If the hotel pays the landowner then the hotel has
    a connection.

    It may not be their land but they are collecting £5 to
    park.

    The fluttering ticket scenario is well known and the courts
    do not like having their time wasted with such trivia

    You stayed 2 nights so you can prove to the hotel that
    you were a customer so contact the hotel, get them to
    contact the landowner to get this cancelled.
    At the very least, what happened to the £5 you paid
    in good faith

    How long did the Ntk take from date of stay?
    Did it comply with POFA?

    Hi Beamerguy, thanks for replying,
    I contacted the hotel who remembers myself and the stay but they refuse to get involved - blaming me for failing to display properly. Wouldn’t even give me a receipt at least for the 2 days I paid!

    Dead end as far as hotel is concerned :(

    Yes there were notices which I didn’t pay much attention during my stay. Only saw properly in photos provided

    NTK took exactly 3 weeks and 5 days. According to POFA it’s 14 days is it??

    OK, they have no option but to get involved because
    they took your £5 ???

    What I would do is question what happened to the £5
    and if the landowner will not cancel and the PPC takes
    this court, you will involve the hotel in any such action.

    Care to name the hotel ???

    There is also trustpilot but that could ruin a business
    and with such ignorance maybe they deserve it.

    Pressure needs to be applied

    Contact the hotel manager, or CEO if it is part of a chain. Complain that you paid for parking but are now being charged again due to the permit not being fit for purpose and causing a frustration of contract.

    The same as this first case.

    The judge dismissed the claim. He ruled that it was the responsibility of the parking company to provide sticky backed tickets and that he had already thrown out 6-10 of these type of cases which Link Parking had brought.


    Appeal to PoPLA using all the relevant points available to you from post 3 of the NEWBIES. Post your draft here for checking before you submit it. Hopefully you didn't reveal the driver's identity so that non POFA compliant NTK will be your first point.

    Complain to your MP and the MP where the hotel is located about this unregulated scam.

    Leavenegative feedback on social media to warn others about this problem.

    Kandk .... the thing I love about this forum is that whilst
    we may use different words, Fruitcake has basically said
    the same thing so please follow the advice as the hotel
    has responsibility in this saga

    I’m really sorry about my posts - I’m trying to do reply with quote but don’t know how!

    Anyway yes Beamer , happy to name the hotel (or B&B rather) - Newark Hotel in Bournemouth. How and what should I ask ?? They were very rude on the phone.

    You may have a get out! But it depends upon the date on the NtK, not when you actually received it unless you can prove date received.

    The relevant section is

    9 (4)The notice must be given by—
    (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or
    (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.
    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.
    (6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.
    (7)When the notice is given it must be accompanied by any evidence prescribed under paragraph 10.


    So you can appeal on out of time, as long as you do not admit who the driver was and always appeal as Registered Keeper. Note also the last bit (7) in bold. Just check that they have complied with that as specified in POFA. Chances are they haven't.

    hoping you can help me once again! (Or anyone else please!)

    I had another look at the original letter received and it says incident date: 21/08 and and then issued date: 22/08 later. but no date on actual letter.

    Didn’t receive actual letter until weeks after incident dates. So will they argue that it was sent on time because of the “issued date??”

    I am very stressed about this! Please help :(
