Car insurance cancelled

Hey everyone,
I forwarded the links to the FCA and FOS positions on this matter and Eldon insurance has got back to me and simply said as I had driven without an MOT i'd breached their terms and conditions and they are still refusing to indemnify me and intend to pursue me for the 3rd party damage.
They have said if I'm not happy I should complain to Southern Rock and provided details of their complaints procedure.
Whats the best next step here? Should I complain to Southern Rock first or go straight to the FOS?
Many thanks!0 -
Follow the advice given by your insurer regards complaining
The FOS will need you to have used the insurers complaints procedure first before they will accept an escalation.
If the Insurer's response is unsatisfactory to you or they ignore you for 8 weeks escalate formally to the FOS
Also consider dacouch's advice of trying an informal approach to FOS now (see #9)0 -
Thanks for your advice Quentin!
I'll pop a formal complaint with Southern Rock now and give the FOS a quick call in the morning to see if they can offer some assistance right away.
Cheers and I'll keep you all updated.0 -
Hi everyone,
I wanted too share an update on my situation and say thanks for all the help on this! I received an email from Northern Rock/Eldon Insurance last week in which they explained that they agree with my complaint and will no longer be perusing me for the damages to the 3rd party. In addition they also reversed the cancellation of my policy so I wont have to declare it to any new insurers and it will show as a customer cancellation.
The reasons given for upholding my complaint were that there was no evidence that the lack of MOT contributed to the accident and that my car passed an MOT following the accident which they took as evidence my car would have had an MOT at the time of the accident if I had taken it to the garage.
I now have all of this in writing and I couldn't be happier! Lesson learned to always keep my MOT up to date but I can honestly say without the assistance from this community I would have accepted their word and now be in a far worse position financially and when taking out any future insurance policies.
The advice and links provided were super helpful so thanks to everyone who posted!!
