  • Thanks for the link KeithP - very useful. I put together a similar six point draft including a point to halt any enforcement. Agreed! Quite important that one..
    I sent it off late last week - so waiting for a response now.
    I'll update when response is received.

  • Yes, absolutely! (apologies for the delayed response - I've been away).
    I applied for the set aside hearing before I went away - Northampton responded around 10 days ago stating my application has been accepted (and cheque cashed) and case transferred to the local court who will be in touch. Which is good news.


    I've not heard anything from the local court yet - BUT I have heard from Gladstone Solicitors - a letter titled 'Request for Rectification Data (Address)'.
    I understand that is to update their records for hounding purposes - but does this mean they are still free to pursue the fine/enforce CCJ/send bailiffs before a hearing date is confirmed?
    Northampton confirmed me the defendant and PCM as claimant in the letter advising application accepted. Surely chasing should be on hold now pending hearing? (one of the points I requested was to put on hold).
    Any experience or advice on this would be great...?

  • until the set aside , they can chase and chase and even get DCBL to send a doorstep collector ,

    You could notify them, in writing, that as your application for set aside hearing has been granted, they should suspend any enforcement action. If they choose not to, any costs they incur in the event of a succesful set aside are entirely of heir own making and will be their cost to bear.
