Indigo parking fine

Hi, I received a fine for parking in a station car park - one I always park in and use the app to pay.

The day I received the fine, I went on the app as normal and paid - when I went to obtain the receipt later that day, I realised the payment hadn’t processed. I immediately paid for a day ticket.

I returned to my car later that day to see I had a penalty notice attached. I appealed, explained I experienced a problem and had paid as soon as I had realised. They have upheld the fine.

Do I have any chance of winning in this case?

    It's a shame you gave away the driver's identity. However, since Railway Byelaws apply, the scammers have no standing to do anything except send you begging letters.

    Did you get a PoPLA code with your rejection? If so then you should use it.

    If not you can either ignore this until it times out after six months, or play question and answer ping-pong with them by sail mail.

    Only the Train Operating Company or the landowner can take you to magistrates court, only for trespass, and only within six months. After that it becomes statute barred. The problem for the scammers is that they cannot pass your details to anyone.

    You should have a good read of the NEWBIES thread to understand all about the unregulated parking industry. You should also complain to your MP and the MP where the station is located if different. You will find information about this in the NEWBIES. Our MPs have called this a scam in open parliament.

    Why on earth would they do that? You have paid, and, AFAIAA, you have breached no railway bye-laws.

    This is anntirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
