3rd work capability assessment

I had my 2nd WCA in December 2017 after filling in and returning my 2nd ESA50 form. The assessment went well and in February 2018 I received a letter from the dwp saying I was in the work related group and I would have an appointment with my advisor soon. I received a letter with an appointment in August. I went to said appointment although I was given the wrong information and told my advisor wasn’t in (even though I found out later he was in the building the whole time) and was sent to see someone else who saw me for 5 mins and took a few basic details. Now in September I have received my 3rd ESA50 form. I don’t understand why I am having to fill out this form AGAIN and potentially have another WCA when it hasn’t even been 12 months since my last one AND I haven’t even seen my job centre advisor in that time, so I have essentially had no support from them. Has anyone else had more than one WCA or have any information about why I might need to have another etc? TIA

    They can reassess you at anytime for ESA. Some people do receive them after just 6 months. Unfortunately, that form will need to be filled and returned by the date stated in the letter, along with all your evidence. Good luck.

    Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....
  • If they don't have any backlogs they send you out the form 3 months before you are due to be reassessed so it looks like you were given a 12 month award.

    This is not correct sorry. As previously stated in my other comment, they can reassess you at anytime for ESA. They do not send the forms 3 months before you are due.

    It is extremely frustrating! If I was placed in the Wrag group for a 12 month review period then surely they should have told me that in the letter I received after my assessment. My condition hasn’t changed in that time- I suffer from epilepsy( which is triggered by stress!) and anxiety and depression. As far as I’m concerned they have not done what they claimed they would and “support” me to get back into work. How do I know if my job centre are changing to UC and is that replacing esa?? The system is so messed up.

    ESA award letters don't state the length of time of your award, this is because they can reassess you at anytime. The ESA50 form comes straight from the health assessment providers and not DWP.


    As for UC, it makes no difference if your area is now a full UC area, unless a change of circumstances prompts a move to UC then you'll stay on ESA. Managed migration for all those on legacy benefits doesn't start until at least 2019, possibly much later for a lot of people.

    Your WRAG award will continue until you have had your assessment so no change there.

    It is difficult to comment on why you have been called for another assessment.

    There might be some clues in the decision letter that they sent you when you were put into the WRAG group. Have a look at where you were awarded points and the comments made.

    What is important is that you complete the ESA50 and send some up to date medical evidence to show that your condition haven't changed.

    I know it is all very frustrating. You could ring and check that they haven't made a mistake in sending the ESA50 - I do know at least one person where it was a clerical error. Probably isn't.

    If by some chance it is a clerical error then make sure you note the date, time of your phone call and the person you spoke to and ask them to read back the note they have put on your file about the clerical error.

    Since you already have a live claim for ESA then you will not have to move to Universal Credit even if you are in a full service Universal Credit area. You will be moved some time in the future but will be informed by letter. Unlikely to happen for some time yet.

    Information about a re-assessment date isn't given in writing, but if you ring them the call handler will be able to see on your records a date for re-assessment.

    That date should be used as a guide, as they can be triggered before that date, or after if there is a backlog in your area.

    Like I said this is now the 3rd time I have had one of these ESA50 forms to complete. I started on esa may 2014 after having to go to a tribunal because I failed the first WCA, I then went to Ingeus for two years which was an absolute waste of time. Then received my 2nd ESA50 in April 2017 which I expected as I was told it would be may 17 when my award ended and I would be reassessed. The letter I received in February just seemed like a standard letter from dwp, there was nothing on there from my wca, it didn’t tell me how many points etc I scored?

    When on ESA it can be 3 months between reassessment, or anything up to 2 years. I have seen a few reports of a more indefinite award term but those are rare.

    Regular reassessments are part of ESA for the majority I'm afraid.

    Despite what a previous poster said I've only ever had standard letters saying my ESA will continue. To know why I've been awarded ESA I usually call and ask for the ESA85. That is the report generated after the medical. It usually has enough information to see where i scored points, and a suggested review term which the DWP usually follow.

    I would suggest you call the DWP and ask about your previous award and how long that was due to run for. It could be an error as suggested, or your last award term was a short one.
