That’s interesting, as the current agent is stating they’re not allowed to do that without permission from the original tenant’s permission.

I don't have a link, the DPS documentation is appalling.
However, if we are talking the Custodial scheme, I have done it recently. It is simply a matter for the outgoing agent to press the transfer button online and enter the Landlord ID of the new agent. It is very simple and does not involve tenant permission, though they are notified on completion.0 -
Is there anything in your contract about how to make a complaint or on the letting agency's website? Is the letting agency a member of a redress scheme? Legally they should either have signed up to either The Property Ombudsman or The Property Redress Scheme.
I spoke to TPOS today and they provided me with the person they have named as a point of contact for complaints, so I shall get that off to them this week.0 -
You may as well just give your current tenants the original deposit when you eventually get it back from the scheme. It will help with goodwill toward you from them, and seeing as you can't deduct anything from it anyway there's no point hanging on to it.
When these tenants leave, make sure you do everything properly with any new ones!0 -
