Hello, a bit of help if anyone knows!
I have sent two applications in under neighbour consultation scheme, 1 has been processed, and 1 has not (Seems they have forgotten about it)
From what i can see the council has 42 days to let me know the outcome of the planning, and if I am not informed I can assume planning is accepted.
If this 42 days from when i sent in the application, or 42 days after it is processed?
I emailed the applications in so I have full proof, with responses from the council

Have they acknowledged your application. Have you checked your local authorities planning website to see what it says regarding the status of the application.
42 days is taken from the date it is validated. i.e. they need to check the information you have sent in suits the information required. You would have received a letter to say its validated and that they have sent letters to your neighbours. Worth asking your neighbours if they have received them.0 -

Thank you for your replies, I sent the applications Via Email, 2 applications, just with differences in the size of the extension. I got acknowledgement emails for both emails that were sent. The council not processing my application is not my fault, I have sent in a Valid application (As they validated the other one, and they were identical except for one said 6m and one said 5m)
Therefore I would guess it would be 42 days from when the application is sent, as a council could take 2 years to 'validate' a planning application for instance.
Only one of the applications has been put on the website, i think they have just forgot about the other one, which I assume can only be to my advantage. As the wording from the government planning "If the local council does not notify the developer within 42 day determination period, the development may go ahead"0 -
you haven't started the determination period if you haven't got a validated application, the determination period is from when the application is validated, not when it is submitted, you should have chased up the admin team to see what has happened to the application, it's likely, if you have sent duplicate applications aside from one bit of text, that they have assumed they are duplicates and only processed one.This is a system account and does not represent a real person.
