Letting agency rent out-without our permission

    I tried to register with http://www.landlordzone.co.uk/forums/
    but never got the email confirmation ....

    We not even sign a contract with the Agency, to gave them permission to manage our property. Every time we ask for the paper, they say "yes we have to do it". We didnt sign anything. This is what makes us worried.

    OK, I know nothing about letting properties, but since you haven't signed anything I'd be tempted to just go and ask for all the keys back to the property. However, I'm a bit stroppy like that.

    It looks as if maybe a visit to a lawyer might be in order...?

    Sorry - I'm sure none of that is any help. This situation is crazy - surely the LA can't do what they have done without getting their backsides kicked?

    If you have no contract with the Letting Agents they can't let the property and therefore any AST they have issued the tenant and signed on your behalf is invalid.

    Turn up at the house with your set of keys, find that there is somebody in there and call the police. Or at least the the letting Agent that is what you are going to do unless they get these people out asap.

    However I think you can only issue ASTs for a minimum period of 6 months. And you did agree to the house being let (if only verbally) so maybe you should just chalk this one down to experience and let the 6 month let take its course.

    Does the rent cover the mortgage? If it does, then it might be best to take action against the LA but let the tenants stay. If it doesn't, sorry tenants but you'll have to go. If the AST was not something that the LA was authorised to sign on your behalf, ie, it was outside the scope of their agency, then it isn't valid.
