Parking charge notice

Hi there received a pcn through post last week
From parking eye demanding £100 or £60 if payed
By 10/10/2018. This was for stopping in a car park in Newquay for 11 minutes while we decided what to do
I find the parking charge a bit excessive and was
Wondering if I should just pay the fine or appeal
Against it or just ignore the letter and hope they
Don't pursue it. Your advice would be greatly
Appreciated.many thanks.

    It is not a fine, it's a speculative invoice.
    The advice to ignore has not been given here since the law changed in 2012. Parking Lie issue about 30 000 court papers per year, so ignoring is a very, very bad idea.

    What happened when you complained to the landowner?

    What was the date of the alleged event, and the date you received the NTK?

    Insufficient grace period to read the signs, then queue to leave back onto the main beach road, no contract agreed. You left and went elsewhere.

    There is no way a court would tell you to pay for an alleged 11 mins that could have been 9 or 10, since we know that ANPR camera timings have been shown to be out by up to 3 minutes at other sites.

    Did anyone in the car have a phone with the Google location app? If so, have a look how long it confirms the car was really there. Quite possibly NOT 11 minutes, and in any case, PE are taking the mickey.

    If no Google location, how about this as evidence, did you then drive & park somewhere else and can you prove that, which will be useful at POPLA stage to prove you didn't accept PE's contract but elected to go somewhere else.

    None of that matters at first appeal stage though, as you will now know after you read the sticky thread I told you to read. Appeal is there, for 1st stage; no changing it.

    Did the PCN arrive by day 15 and does it have the POFA 2012 on the back?

  • Hi again it was just over a month after the alleged parking offence and yes it does have pofa 2012 on the back.

    - date of first PCN (NOT the thing headed PCN Reminder' nor the letter talking about liability being established).

    Also just checked the charge notice and it does not have anything about pofa 2012 on it!

    Template to fight this charge as I genuinely think this is a rip off and to pay them a penny would be an injustice.
