CEL Defence Help please! - Sense of Urgency have to file in next few days!

  • Just to update on this thread, I did end up at court and CEL also had hired a barrister on their behalf for the day, now when I was researching this whole company and their 'common practices' there appeared to be a common theme that CEL did not show up for court - they may well have changed tact!
In a nutshell, I had previously requested proof from CEL that they had authority or a valid contract with the land owner to issue PCNs, in their response they had advised that a copy of the contract could be provided on the day of the hearing if required. I asked the judge if they could produce it, they couldn't and the judge ruled in my favour and dismissed the case, awarded my loss of earnings and surprisingly CEL actually paid too!
If anyone is in a similar situation and would like some help or advice please feel free to get in touch as I know how much of a ball ache all this is!
    Ta.

    Well done, excellent result. :T

It has been the CEL modus op for the past couple of years to discontinue where it was clear that the motorist was putting together a solid defence and would likely turn up in court. But over the past few months they have occasionally fielded a gun for hire legal (or one of their own staff) at an actual court hearing. From memory, these cases were in and around the London/SE area.

Can you please tell us at which county court your case was held please? It will help us hone our advice to CEL victims who will be treading the same path as you have, in the coming months.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Thank you!

This hearing was at my local court Lancaster.
