So I now have the original PCN and a doctored copy. Should I inform them of this and ask them to discontinue action or let a court decide whether this is acceptable?.
Hi the clocks ticking on this so I’d be grateful for your advice. I am unsure whether to write to them or not but they are pigheaded anyway and would probably continue. I would hope the court would be concerned though.
Thanks in advance.0 -
Why not write to them, and then use your comms as evidence that they knew they had produced false evidence but did nothing. You could then push for costs on the indemnity basis (i.e. more costs than basic losses for attending a hearing).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi by way of an update.
I received a response from BWL 'complaints team' on 27 April. They appear to have treated my letter advising them that they have still not produced any of the requested evidence and have potentially tampered with evidence as a complaint.
Accordingly, their response is quite odd as it refers to me as the driver despite no admission of this. They also continue to alter the address of the alleged breach in each piece of evidence they provide. It is without doubt that they do not know where the incident was alleged to have occurred. (They contend that it was at a works (factory?) which is not known to us.
They do state that they may request the County Court to issue me with a claim form at my address without any further notice and state that they do not uphold my complaint (which I never made) and if I remain dissatisfied to refer it to the legal ombudsman.
As I say they again have not addressed any of my requests for information nor have they commented on the fact that the original PCN differs from the copy they sent previously.
Are there any merits in using the legal ombudsman. Given the fact that they have completely failed to provide any supporting evidence and that their paperwork is atrocious, would the ombudsman intervene? Or should I wait for the LBBC?
They sign off by stating that if they do not hear from me within 14 days they will assume that I am happy (which I'm not) and will update our records.
Any thoughts?0 -
