Advice please: our vehicle stolen from car dealer

    Actually it is although maybe not by the dealer's insurance. The dealer in law has a duty of care and responsibility for clients vehicles, whether on their insurance policy or not.

    We had a van stolen from a dealership that we had sent for repair, Their insurance excess was £25k, so it ended up costing them dearly, best part of it they hadnt even realised it had gone for two days !!! Some Gipos loaded it onto a flatbed off the forecourt in the dead of night. Never saw it again.

    It's legally up to them but it might be hard to prove especially with the change of owner.
    How much was the car worth?

    Will there be any insurance implications to handing the car over to the dealer? It's not being kept at the usual address or in your care so they might not be interested in covering it.

    OP, check your car and home insurance policy to see if you have legal cover. See if you get legal help from a bank account, union membership etc. If the car is worth the hassle, then get help through the legal cover policy to get it sorted. It's not your responsibility to try and work out the law - that's what solicitors are for. Personally, I would have thought that the car was in the hands of the car sales place, so they would be liable for the loss. The fact that they sent you pictures of their online listing would support that.

    If the dealers premises were burgled how would they have been negligent? The OP suggests they could have left the keys in the car but this seems to be speculation.

    Trade policies will usually cover vehicles in their possession as part of their specified business activities. So why it won't cover it I don't know but if theirinsurance dont, they should be covering it. That's if they can afford to. You may be chasing air

    I'm wondering if that was officially part of the garage, or if the employee friend just had the car parked at the end of the forecourt with a for sale sign on it.

    It could possibly be argued that a business taking possession of a vehicle belonging to someone else then storing it on their premises without ensuring that it was adequately insured for loss or damage is negligence in itself.
