Party Wall Question

Hi, I'm new to the forum, and impressed with the knowledge on display - so here is a nice little party wall question :) .....any help greatly appreciated.

Our proposed build is more than 3m from the neighbours wall, and they are a 4000mm step down from our property, so their foundations will be deeper (all things being equal, and reasonable assumptions made about similar houses on same street), so on both counts, no PWA notification required; EXCEPT...they have build a porch which protrudes to within 3m of our proposed two storey build...and being a porch its foundations will be very shallow, so regardless of the 400mm drop, our 1000mm planned foundations are almost sure to be deeper, than those of their porch.

Do we need to serve notice under the PWA, just because of their porch; or can we regard same porch as irrelevant, purely because it is just a porch.

    The porch is part of their building. The Act applies.

    Speak to your neighbours about it before you serve notice.
