How long had the customer had it? Was the maintenance something simple for them to do?
At a value of £4000 odd I'd expect maintenance to happen even if they had to pay someone specialist to do it. People pay for boiler maintenance all the time for instance. I pay for my musical instruments to be serviced and the most expensive one is still only £2200.
Obviously if it was simple then that strengthens OP's case. As would providing instructions detailing what maintenance is needed.0 -
Ignoring the £4400 claim for the moment, what was the original value of the item in question, and how old was it when the fault developed?
Did the customer accept any offer of repair from you, or did whoeveritis decide to bypass you and get the repair done themselves?
Sounds like the claim is for a new item plus the cost of repairing damage to the area where the item is situated and I think if the claim goes against you then you need to start your own action against whoever took a hammer to the problem and destroyed it as well as causing further ancillary damage.0
