Carer’s did not have Tax

We really don’t want to continue with my son's Care Agency as we have evidence that one of the Carer’s did not have Tax on the car DS2 was riding around in. Therefore not insured. I did have a bump on that Carer’s car who has started a County Court Judgement for nearly £5000. Even though I am fully insured and we exchanged insurance details at the time. I can only assume my company would not pay out as they were uninsured and so they are taking me to court for their losses even though uninsured.

Have contacted my insurer who have asked for CCJ to be emailed over and say they have paid out over £1000 already.

Should we be suuing the Social Worker and or Care Agency?

Will I have to pay £5000 and incurring costs? Worried.

    Let your insurer's fight the battle - that's what you pay your premiums for.

    The Carer using his/her own vehicle and its taxation/insurance and indeed the drivers license is something you should raise via your Social Worker - I'm sure it will be part of their contract and they should have procedures to ensure this is in place.

    Your post isn't overly clear. Did you crash into your son's carer's car and it wasn't insured? Or did the car have a crash whilst your son was in it and somehow they are saying you are liable? I do hope you weren't driving the carers car? I just can't tell.

    But certainly raise these concerns with social services. I used an agency who provided a PA for my son and I have to say, I wasn't impressed at how the agency carried on or the PA. The PA claimed to be doing hours he wasn't, doing things he hadn't, and it seemed although I was told the PA was being paid for 16 hours work verbally, the way the contract was written it was needs based and unprovable as to whether those needs were being met or not. It seemed to be a lot of money for much much less than the hours they were being paid for and nothing I could do because of the way the contracts were written.

    To be honest, it seemed rather a good opportunity to con the state legally.

    Because I have worked in admin and am used to contracts (more concrete terms) I was quite shocked how it all worked and social services didn't seem interested in how poor and loop holed the contracts were.

    This is not correct. Having no road fund license would not invalidate carers insurance. They are taking you to court as they think you are liable for the damage to carer's car.
