Window Company in Manchester

We had doors and windows installed by a local company "manchester window factory" just under 2 years ago . We had a nightmare trying to get the install finished to a reasonable standard. In the end we had to accept we got as much as we could out of them in terms of engagement to get the job done as they were extremely unresponsive - taking in total 6 months to resolve basic issues.

This week we have noticed the door has started to leak when it rains. I sent an email 5 days ago direct to the directors and as before we get no response. I'm loathed to go through this frustrating process again. Can you advise what i can do?

We have a guarantee worded as follows:



Manchester Window Factory hereby offers the following guarantee terms in relation to your installation.
Window and door frames are guaranteed against defective workmanship and/or defective materials for a period of 10
years starting from the installation completion date.

Sealed units are guaranteed against defective workmanship and/or defective materials for a period of 10 years starting
from the installation completion date.

Fascias, soffits, bargeboards, guttering, locks, handles and other moving parts are guaranteed against defective
workmanship and/or materials for a period of 10 years starting from the installation completion date.

Conservatory bases are guaranteed against defective workmanship and/or materials for a period of 5 years starting from
the installation completion date.

The following exclusions apply to the Guarantee;
1. this guarantee does not cover any accidental damage (including glass breakage), blockages, wear and tear,
misuse of the product and any faults associated to condensation
2. this guarantee does not cover any problems associated with the penetration of insects, misting and mould
growth
3. this guarantee does not cover any problem in the event the consumer fails to adequately maintain the product or
misuses the product
The choice of whether materials are either repaired or replaced is at the sole discretion of the Installing Company.

  • Your rights under a guarantee are based on what's written in the terms.

    You also have statutory rights under the Consumer Rights Act 2015. You can choose to exercise your statutory rights instead of a guarantee if you want.

    CRA15 says that

    Any service needs to be provided with the reasonable care and skill expected of a trader in that field.
    If not you can ask for a 'repeat performance' (ie they fix it) which should be free and in a reasonable time.

    The onus would be on you to demonstrate the service was substandard.


    Or if the actually door was faulty (as opposed to the workmanship)

    Goods need to be of satisfactory quality. If they are not you would be entitled to a free repair or replacement within a reasonable time.

    Onus still on you to show the goods have an inherent fault.


    Depending on how you paid you might have more options.
