BW Legal - 3 x Country Court Claims Issued.

I have recently received notice 3 x county court claims issued against me for parking charges from last year. Two were from my university and one was from my place of work. I do not want to admit liability and was wondering what i am able to do next.

1: You must read the newbies thread carefully

2: Explain how all this happened
  • I have read through the newbie thread, it advised to start a new thread as the specifics will need to be explained.

I can't remember specific details of exactly what happened as it was such a long time ago. However, I have received numerous letters and calls from different debt collectors & legal firms trying to get me to pay. This seems like harassment as I would have been studying in my final year of my degree, combined with getting a new job and moving to a different county.

if these are about 2 separate companies and/or 2 separate incidents (or god forbid , 3 completely different cases or incidents), then you need to start one thread for each incident , seeing as you state that there are 3 court claims

if two are for uni and one for work, start a separate thread for the one for work and leave this as 2 uni claims (assuming the uni ones are exactly the same)

then write the DATE OF ISSUE and POC details for each claim, name of the PPC etc
  • Okay will do, thanks.

For the uni one, the date of issue for the first was 26/09/2017, the POC is as follows - 26/09/17 at City College Norwich. The PCN allowed defendant 28 days from date of issue to pay, but failed to do so. Claim includes interest of 8% per annum, a daily rate of 0.02 from 26/09/2017 to 24/09/18 with a total of £7.28. Claimant also claims £75 contractual costs pursuant to PCN T&c's.

The second is the same but date is - 09/10/17. 0.02 from 9/10/17 to 24/9/2018 totalling to £7.02.

The PPC is Norwich traffic control (NTC).

First thing MUST be to do the Acknowledgement of Service on MCOL for each claim, to buy you time to defend. AOS is shown in pics in the NEWBIES thread 2nd post where it then tells you about what else you must do and when/how.

Are all the claims from the same PPC and Solicitor?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Okay, I will get that done asap.

Yes they're all from the same PPC and solicitor.

Give the dates of issue for each and every one.
You have 33 days from each one to submit the defence to the court. You cannot miss this date.
You will be emailing it. Part of the defence, if it is for the same location and company, you will be asking the court to combine the claims - it is an abuise of process by the claimant to file seperate claims for the same incidents.
  • What action would be best to take, MCOL has options for AOS and a response form which disputes the entire claim?

    Thanks
  • The dates of issue are both different, can two claims be issued if they give two different dates?
Also, is it worth contacting the establishments of where it took place (my work and uni) to see if they can drop it?

    thanks

Read post #2 of the NEWBIES FAQ sticky thread.

In there you will find a link to a Dropbox file which describes exactly how you should complete the Acknowledgement of Service.

You have already been asked, but again, what are the Dates of Issue printed on each of your County Court Claim Forms?
