thats better, like I said and so did CM above, we want EXACT details if we are to help you , dont cut things down when we ask for full details
we want to see what you can see, otherwise you wont get a decent reply
please do the AOS online after reading how in that NEWBIES thread, post #2 (it has a pictorial tutorial to do it)
and stop using a phone, use a laptop (a phone does not give you all the internet access you need, just a cut down version with missing info)0 -
Ok I have spent the afternoon reading the newbie thread
So if I am correct I now need to fill in the acknowledgment form and build my defence to send to the court. I believe I can also do this online.
Do you think it would be worth writing to Gladstone solicitors too?
Thanks again for your help.0 -
Sorry didn’t see last reply. Ok I will build my defence tonight and submit online tomorrow.
Do you think it’s worth contacting Gladstone also?
Thanks x0 -
Do you think it’s worth contacting Gladstone also?
To say what, exactly? Do you seriously imagine they are going to take a blind bit of notice of anything you say?
They are the pondlife of the legal world, helping their highly dubious clients to issue a string of robo-claims like a sausage factory.
They are only interested in extorting money from you. You have to go to court, beat them in court, and get the Judge to award the maximum possible amount of costs in your favour, that's the only kind of language they understand.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Do you think it’s worth contacting Gladstones also?

and this is PCM and what they do:
http://parking-prankster.blogspot.com/2015/05/is-it-pcm-uk-who-make-up-stuff-all-time.htmlOk I will build my defence tonight and submit online tomorrow.
You do ONLY the Acknowledgement of Service on MCOL.
Then that buys you time to work on a defence properly this month. In March of this year we were issued a PCM. We were parked in a visitors bay with a valid visitors voucher clearly displayed.
The painted bays were very faded.
We moved here in aug 2017 when a different parking company were in management and the visitors bays were already faded but was always ok to park there with a valid visitors voucher.
A new company took over in the January parking control management.
Were you consulted at all, or just had that bunch foisted on you?
Are you a tenant, and is it a private landlord?
Show us your defence, and do not reply if a relatively new poster sends you a private message trying to steer you into route or a defence only they suggest. If you get a private message from a poster saying they are trying to help, tell US and do not reply (could be a parking firm, or any old chancer).2 days after our appeal was dismissed the pcm company repainted the lines on the bay!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

1. The 19th sept is the issue date on the claim form.
Having done the AoS, you then have until 4pm on Monday 22nd October 2018 to file your Defence.
That's nearly three weeks away. Plenty of time to hone your Defence to perfection.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.0 -
Honestly! Thank you so much, you have already helped so much. Ok I will do the AOS and work on perfecting our defence!
I’m a HA tenant but the land the house is on is private so parking control management were employed by the land owners who I have contacted today and still await a call from.
I have photo evidence of the faded bays and the bays freshly painted 2 days after my appeal was rejected.
I am also going to get my neighbors to sign a statement stating that the are in question has and still is visitors area.
With your fantastic help it gives me hope!
Thanks again.0 -

That is the key to your defence so don't lose it. PCM operate on making the signs vague, too high up, or confusing. Which is why people see them and the IAS as scammers.
This will progress as it is the fear of court that makes people pay and not the facts of the case BUT as this is your money and time, you have to make a decision as to whether you have the will to take it all the way. Given the stated health issues not everyone is up to 6 months of paperwork.
Support will be here, but you might want to consider having a "dry run" at your local court to see how these cases work and to reduce the fear of court. Courts are open to the public to sit and view (quietly and respectfully)This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0
