Civil Enforcement Ltd- Scotland

Hi,
I live in Scotland and need help with CEL....
Stupidly, CEL have my name and know I was the driver and I am getting these horrible letters. I parked in a (closed) GP surgery on a Sunday for 15 mins to pick up my 6 year old from a party at an adjacent building . I drive a lease car so admitted in the appeal that I was the driver.
What do I do ? Ignore the letters as they can’t take me to court as I live under Scottish law and they are an English company?
I’m so fed up I am thinking of just paying.
Any advice, please?

    Yes.

Don't be daft, I've ignored letter chains like that before and they were amusing!

But be forum savvy; if you get a private message on this forum, from any new poster offering to 'help' off forum and stop the letters, DO NOT REPLY - and tell us instead who contacted you and what they said.

The combination of Scotland and debt letters is something to ignore, and we are wary of new posters who have an agenda who might contact people like you to persuade you that there is an answer to stop the letters. You do not need it and such pm's are not to be trusted - out of the frying pan into the fire...

Just so you know. Carry on ignoring!

because you were foolish and admitted you were the driver , then YES they can take you to court in Scotland, using your simple procedures system and for breach of contract

    http://www.scotcourts.gov.uk/taking-action/simple-procedure

they have 5 years to do this (and yes it has happened before)

it is a keeper that isnt liable under Scottish law, but contractual laws apply throughout the UK and a driver is definitely accountable
  • So you differ to “Coupon-Mad” who says ignore? Interesting. Thanks for taking the time to reply.

As Redx says ..... however you can still try to trip
    them up regarding the signs

You need to take photos of the signs as seen entering
the car park and those within the car park

Why not do that and post them on here using one of
the free services to upload pics.

Then post the link here using hxxp and we will make
it live. Worth doing for expert advice

I dont believe she realised you admitted to being the driver

because most people in Scotland have not done that, we tell them what she said because a KEEPER is not liable in Scotland

people here may skim read and because we see the word Scotland we tend to get our brain into a PLEASE IGNORE MODE

but this is clearly not true for a driver
as they can’t take me to court as I live under Scottish law and they are an English company?
so I dont know where you got that idea from ?

I did realise, but it's CEL who were taken to court in Scotland for fraud, only the case was mishandled and badly pleaded IMHO, and they were cleared:

    https://www.eveningexpress.co.uk/fp/news/local/parking-firm-cleared-of-fraud-after-landmark-court-case1/

CEL are not likely to try a claim there IMHO. So ignore is ignore.

I can see that my quote of your phrase wasn't ideal, because you are not right to say that they CAN'T take you to court. They just won't...!
