Entitled to refund? - construction noise at villa

I've recently come back from a 2 week holiday in Florida.

The villa where we stayed at was on a new estate and villas opposite and down the road were being constructed and therefore was very noisy in the weekdays from workers/construction activities.


We have documented this and informed the management company when there. Do you think we can be entitled to a refund? It did cause a lot of disturbance for us when trying to relax at the villa and was not in the advert that construction works were on-going? They offered us an alternative villa after a few days but it wasn't to the same standard and we refused as didn't want to move from one problem to another. The booking agent/management company are refusing to provide a refund as they feel we were offered a suitable alternative which was the only one they had available which we refused.

    I would agree with the villa management company. No refund.

    Possibly a small payment but even that is questionable as they offered to move you.
  • Subjective excessive noise, refused offer to re-locate, but still want compensation. I don't fancy your chances.

    No chance.
    Ususally what happens when people are truly inconvenienced is they will GLADLY move house/villa/room and this disruptions is a good basis for compensation.

    The fact you didnt suggests the 'inconvenience' wasnt so bad.

    and stayed the entire booked duration, rather than flying home early, no doubt

    If it wasn't bad enough to move to a slightly less good villa then there's no way it was bad enough to mean you get all your money back! People don't event get a full refund when things were so bad they went home and cut short the holiday!

    So your holiday wasn't ruined, it just wasn't as good as it there wasn't any noise. I don't kniw whether the villa company have any responsibility for that unless it was their building works.
