Refund on Holiday

Hi,

I am a newbie but hoping you can help.

My friend was due to get married in Crete next summer. She worked with a travel agent she knows and has been using for years. It was my friend who got he quote and I was sent booking details by text. I paid the deposit of £750.

The wedding has now sadly been called off and I have contacted the travel agent to cancel the holiday and ask for a refund of the deposit. The travel agent has now said the refund is non-refundable and that she didn't actually ask for enough of a deposit and that I will have to pay an additional £75!

I have checked the paperwork which I only received after the deposit had been paid and there is no mention of the deposit being non-refundable.

Anyone know what my rights are? I thought that to be non-refundable that would have to be made clear to me prior to booking.

    Deposits are unfortunately generally non refundable.

    Did you pay the deposit to the travel agent or your friend, is the travel agent in the UK?

    It's a holiday (your word) so why not go anyway and enjoy yourself?

  • That's the whole point of a deposit.
    You put it down on a non refundable basis to lock you both in to an agreement that you are going to buy and pay for something later.
  • To answer some of the questions...

    I want to cancel because it’s significantly more expensive than I would ever have paid just for a holiday - the only reason I booked something that expensive or in that location was because I had little choice (I was meant to be a bridesmaid)

    The travel agent is in the UK

    I was never told the deposit was non-refundable. Deposits are not automatically non-refundable and I thought you had to be clearly told before payment if that is meant to be the case. The deposit was big so it would mean a lot to get it back.

    who are the flights with? was this a true 'package' (one price) or flight and accommodation
    it would be unusual for a contract to be silent on Cancellation, is there a section for that?

    The paperwork arrived about a week after paying the deposit.

    There was no mention of terms and conditions, cancellation terms or the deposit being non-refundable before booking.

    You can get insurance that covers you for cancelling for any reason - so I thought it was worth asking. Though actually now I've said it I don't know if you can get in in the UK.
