Lease vehicles and registered keeper

Hi all,

Someone recently received a Notice to Keeper parking fine from Euro Car Parks, which I appealed using a template from this site and has been rejected. (Original appeal made no mention or admission to being the driver nor knowing who the driver was)

I have two questions:
1) Someone was named as the driver of the car by the finance company who are the registered keepers of the vehicle, however they were not, nor are they the legal registered keeper of the vehicle themselves, basically the vehicle is a lease vehicle and they have been incorrectly named as the driver by the finance company, does someone have a leg to stand on here with regards to POPLA appeal?

2) Secondly, the NTK that someone received is dated over a month past the date of the event, does someone have a leg to stand on here with regards to a POPLA appeal?

    No they weren't. The person was named as the LESSEE of the car, and then the PPC sent the LESSEE a 'Notice to Hire' (of sorts).

    No party except the driver, knows who was driving, and let it stay that way.

    The NTH has to be served within 21 days of the PPC being told the name & address of the LESSEE, and it has to enclose a couple of documents as set out in para 13/14 of Schedule 4. Read those parts of the POFA! The NTH was not compliant, was it?!

    So the LESSEE then uses that as their first point at POPLA. Search the forum for POPLA hirer paragraph 13 14 POFA or keywords like that! Copy one, edit & adapt it to suit your case, and show us.
