1 day, 2 tickets Newquay

Hi everyone. To say i"m livid, is an understatement.
My wife and I, decided to spend the afternoon in Newquay, on our way to St. Ives. With us was our 3yo and 1yo. 02/09/18. It was a very warm day, after a few weeks of not so great waether... Newquay was heaving!
Arrived at Tower Road carpark, expecting to be able to pay with a debit card (at the machine) at it's all new singing and dancing parking eye system, but no. Both our phones were flat. So we parked up (after a bit of a wait) and I went off in search of change. This took about 15 minutes as no one (understandably) wanted to hand out change. But pay we did, eventually, ticket on the dash, and off we went to Fistral.
Lovely afternoon, someone came back to the car with about 10minutes left on the ticket, to drive down to Fistral to collect the family. Having done the walk down, decided it was be a nightmare trying to get the kids and all their clobber back to the car up the hill.
Drove fistral beach carpark about 3pm, it was absolutely packed, so someone headed down and waited as close as they could to the footpath. Ferried the bags up and down to me, take the kids for wees, load the car up, and off we went to st Ives. This took about 25minutes. We did not park in a bay.
Now waiting for us when we got back was the letter from smart parking (fistral). I literally couldn't believe it. Spitting feather etc etc. Today, I received a letter from parking eye (,tower road). This appears to be a follow up letter advising I can no longer pay the £60 and the fine is £100. This is 23 days after the alleged offense. I NEVER RECEIVED THE FIST LETTER).
So I can see how they have been given a ticket for fistral, even if it's totally !!!!!!!ly of them. There were no parking spaces available to park, even if i wanted to. I effectively queued for 25min and left (with extra passengers)
But for tower road... i paid! We bought a bloody ticket, and we were back before it expired.
So have someone either put the wrong registration in at the machine (this should be banned). Or they've fined someone for not paying quickly enough as someone went to find change.
Anyway sitting on 200 quid worth of tickets.
Do I pay these digital parking crooks?
Regards

Everyone is politely asked to read up on this in the newbies faq thread near the top of the forum before starting a new thread
Assuming you want advice and not just a rant, then go there now to get an understanding of the game you are now caught up in and how to deal with this
Throughout here you are advised never to reveal who was driving
You need to edit your post to remove details of the driver

It really is that simple and that's why the NEWBIES thread is in capitals at the top of this forum, calling newbies to 'read it first'.
Smart will cancel in October, as they don't like the NEWBIES thread template appeal.
ParkingEye will not cancel, but use the template appeal anyway - on the PE appeals page (to get a POPLA code, basically) and also separately do this:visit our website at https://www.parkingeye.co.uk/privacy-policy/ to contact us using the online form under “How can you contact ParkingEye if you have a privacy related query?”
and describe your query as a SAR (search the forum for SAR GDPR) and ask for evidence of the payment made and data held, as you need to understand whether the allegation is 'overstay' or not putting in the right VRN.
BE CAREFUL, NO IMPLYING WHO WAS DRIVING! So not ''if I put in the right VRN'' nor anything daft like ''I parked & paid and...''.
Have you still got it? Keep it.But for tower road... i paid! I bought a bloody ticket, and i was back before it expired

Jut to add, you didn't have a relative pet-sitting or house sitting, did you? This is 23 days after the alleged offense. I NEVER RECEIVED THE FIST LETTER).
I hope you didn't, and that they didn't take the 1st letter fake PCN home and pay it, and they kept that quiet from you to save you the worry...
It's a scam.
And the PE one can be beaten at POPLA. The Smart one will be cancelled earlier.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

and slightly longer, the committee stage
https://www.parliamentlive.tv/Event/Index/d5550515-cce9-4185-83ec-754dadb7524a
''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.
These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.
and some quotes from the committe stage
"The other area is hospital parking, and I want to single out one company for some pretty shady practices. That is ParkingEye"
" is very clear to me that there is collusion between parking companies and solicitors’ firms—so-called roboclaims companies. "
"They are often set up adjacently and involve the same directors and personnel. Incidentally, the same personnel get involved in the so-called appeals bodies."
"Essentially, it is a money-making enterprise that takes advantage of motorists up and down the country. They operate in a very business-like fashion, which is why I call them roboclaims companies."
"The companies are jamming up parts of our legal system."
“I now pretty much know exactly how the parking companies and in particular the IPC have been running this scam for the past 5 years. Basically both of the appeals processes are a complete and utter sham, (and part of that sham is Gladstones Solicitors itself)”
"The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever,"
" It is claimed by the head of the appeals service (retired Judge Bryn Holloway) that this is a completely independent fair process, it is not”
"The letter mentions two individuals—Will Hurley and Bryn Holloway—and concludes this is a typical example of the clear collusion between the IPC, their members and the IAS"
"what we can do about roboclaims companies and solicitors firms that profit, often in shady ways"
" the very large amounts of money that can be involved in such scams—a company called Smart Parking was involved in one such scam on my patch"
"tightening up the rules regarding the unfair use of automatic number plate recognition" "BW Legal, regularly issues 10,000 county court judgments a month, and is known to have issued 28,000 in one month"
"They are jamming up our court system, and are often totally unjustified."
" because the lifeblood of trying to extort money from people is having access to their details."

No problem, but make sure you do the SAR as explained above, to PE, as well as the appeal, because the SAR will show you what they are saying, all the data. You will need that info for for POPLA.
Smart will be a cinch by comparison but both are generally beatable.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just checking, one ticked has been issued over a month after the alleged offence, does that matter? Am reading a lot about 14 days from this point to that point but not sure what those points are. =S0

I assume you mean the Smart one? You will know from other Smart cases - and from the NEWBIES thread, where it is specifically stated - that Smart don't use the POFA, so can't hold a keeper liable, which is why you will win/they will cancel.
Never mind the POFA 14 day period, it's not a POFA PCN! No keeper liability, game over!
Unless you mean the PE one? That probably does have POFA 2012 on the back.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was for the PE one. Reading up on 'parkingfine-appeals.co.uk/keeper-liability-explained'
which states...
7. A notice to keeper must be served not later than 14 days after the vehicle was parked
The stated date of issue on the ticket is 23 days after the alleged offence.0 -
Hooray!!!!! :T
You are the proud holder of a GOLDEN TICKET with no POFA words on the back!
You'll win both your cases, the PE one will go to POPLA but you win.
Neither of those PCNs can hold a keeper liable, you are laughing!
Go to the 3rd post of the NEWBIES thread about POPLA stage, and look at what I say there about ParkingEye Golden Tickets.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
