civil enforcement pcn for mistyped reg

I have received a pcn from civil enforcement - Liverpool --- the car reg was correct apart from putting YWA instead of WYA - I have the parking ticket - do I appeal ? - which I believe they will reject , so I will have to appeal to POPLA - which will mean paying £100 instead of £60 ---- I read that POPLA do not use common sense , and support the 'technicalities' these firms make you pay for - if other people have tried and failed I may as well bite the bullet and pay now -- any advice ?

    Send the template blue writing appeal in the NEWBIES thread and CEL will cancel by the end of October.

    You appear to have missed the point, when you read the top thread:

    NEWBIES PLEASE READ THESE FAQS FIRST

    before you posted, that you must appeal as registered keeper, not saying who was driving and NOT babbling on about the story of what happened.

    It is easy, stop overthinking it, that's why the top thread says to read it FIRST!

    Please do NOT reply asking ''is it this one?'' as we will not reply...please spare us. And you don't need a link to the NEWBIES thread either, see my signature for where to click.

    Come back and tell us when CEL cancel.

    I see the blue writing - but firstly it says appeal online -- Civil Enforcement do not have an online appeal procedure --- and the blue writing mentions signage etc - as I was not the driver I have no idea if the signage is okay or not - surely all I can appeal is that I was not the driver ?

  • just read this in the POPLA results thread (25/9) Appeal disallowed !

    Assessor supporting rational for decision
    I have not been able to confirm the driver of the vehicle from the evidence and admissions provided by the appellant. It is evident that the operator is seeking to make use of keeper liability provisions as outlined within the Protection of Freedoms Act 2012 (PoFA 2012). Therefore, I must consider whether the Notice to Keeper sent to the appellant met the requirements laid out within this act. Having considered the requirements of PoFA 2012 (Schedule 4, Paragraph 9(2)), I am satisfied that the Notice to Keeper sent to the appellant on 21 June 2018 does meet these requirements and this was sent within the “relevant period” outlined within PoFA 2012 Schedule 4, Paragraph 9(4) also. Therefore, I can only conclude that the operator has met the requirements of PoFA 2012, which entitles it to pursue the registered keeper of the vehicle for unpaid parking charges in the event it does not receive the full details of the driver within the period specified.

    Yes they do, by email I think, or an appeals page on their website. No-one has reported having to post by snail mail, an appeal to CEL, which is not recommended as post gets lost and we do NOT recommend signed-for post to a scumbag firm who won't sign.

    No. ALWAYS mention signage! It's the crux of the alleged contract and is always pants, and you do not need to go and check, to know that.

    Just use the template, what you are missing is the subliminal message it sends to the likes of CEL, who will cancel purely because they know you are here and will win.
