Hi All,
Long time no threads hope you're all OK. got a letter from St Helens County Court which reads, it's a bit long winded but bear with me:-
"The hearing of the defendant's application for To Stay (see copy attached) will take place at 11:10 on the 8th November 2007, at St Helens County Court.
Cases are listed in accordance with local hearing arrangements determined by the judiciary and implimented by court staff. Every effort ismade to ensure that hearings start either at the time specified or as soon as possible thereafter. However, listing practices or other factors may mean that delay is unavoidable. Furthermore, in some instances a case may be released to another judge, possibly at a different court. Please contact the court for further information on the listing arrangements that may apply to your hearing".
Couple of questions
1 Do we need to take our court bundle with us with copies for Shabbey, judge & ourselves?
2 Should we expect the Stay to be granted?
3 Is there any point in turning up?
Thanks to all in advance
Mark

Hi Mark, hope you don't mind me adding to your thread.
I have a court case this Thursday the 8th November.I am reclaiming bank charges from Alliance and Leicester.
Got a letter from the Sheriff court Glasgow saying that the Preliminary hearing is Thursday 8th November at 12:00
I was wondering if anyone knows what the proceedure is.Do I have to attend and what information I have to take with me.
Thanks in Advance.0 -
I'm also hi'jacking your thread.
I have a court date on 14th Nov 07.
I gained judgement by default, then got a warrant but HBOS are requesting that a stay be granted.
They have sent me their witness statement to back up their request but it all refers to the original case, rather than mitigating circumstances relating to the warrant.
I guess my queries are the same as Mark, should i go, what should i expect and how should i prepare myself for it?
Should i get legal advise or should it be fairly straightforward? I'm not even sure if they intend to turn up or not.0 -

Hi Sym0n
What arguements did you put forward to appeal against the stay I tried putting it in writing to the Shabbey and the Court, I used a template letter which was very kindly put onto the reclaim bank charges thread by stokey125 but still ended up with the letters saying the stay would be granted to the bank. If you have copies of your appeal aginst the stay, could you post them on here, so I can use the same wording.
Thanks in advance
Mark

I got a judgement by default, then got a warrant issued but they have still applied for the Stay and the court date is 14th Nov.
No idea what to expect or how to prepare, anyone got any pointers?0
