PCN Redbridge for car which was cloned - Bailliffs attended!

I have been reading the forums but it doesnt quite answer my query.



My partner bought a car from ebay at the begining of February. This car has not moved from our back garden in the midlands since he collected it as he has been working on it. It can be seen on our neighbours CCTV.


Within 2 weeks of buying it he got a number of parking and speeding tickets from Essex. We have never been to Essex and neither has the car (in our ownership).


It was clear immediately that there was another car going round with the same plates.


We contacted DVLA who advised to contact the police and to write to all the ticket issuers about it with details, which we did. We also contacted DVLA in writing explaining and asking for the plates to be changed. They did this quite quickly.



We received no more tickets and the police and DVLA tickets were squashed.


However, we contacted Redbridge in the same way and at the same time as everyone else, yet they have continued to send notices, the charge goes up and we write again, i have even appealled through thier online portal, To date they have not acknowledged anything.


We had a letter a few weeks ago about thier intention to take the matter to court.

Since then we havent heard anything until today when balliff came to the house leaving a removal notice. My partner spoke to him and he ws very understanding and tomorrow I am to send him the details of what we have sent to Redbridge. I am happy to do this.


However I am concerned this will simply be sent to someone else to collect.
We were not offered chance to defend this in court, how can there not be a judgement sent to us or we be given opportunity to defend it?
What can we now do to put this to bed?

Do you have a 'Bill of sale' 'Invoice or 'Receipt from the person whom you bought the car off as that would be definitive proof of you not being responsible for the PCN,s


OR


If your number plates have been cloned again you would have proof of with the PPC ANPR images not matching your car.


I'm not sure about the bailiff situation, there must be a CCJ achieved against someone and now its been elevated to the high court with a 'Enforcement Writ'


Of course the 'Writ' is not for you and unfortunately you'll just have to keep telling whoever writes to you or turns up exactly what you have stated here.


Criminals do operate and mistakes are made by bailiff companies etc but I personally wouldn't lose much sleep over it, just deal with it as it comes.


I had a company (MIL collections ironically!!!) chasing me for an alleged debt (£5500!!) for advertising space a few years ago, I rang them ONCE to enquire, they said you have to pay mr ******, I laughed as that isn't even my name then quoted them Liam Neeson in Taken saying"GOOD LUCK" never heard anything again haha

We are the registered keeper of the car at the time of the offences, the cars been cloned, its not our car getting the PCN its one with the same plates which were captured from the ebay listing we beleive.


Sicne the plates have been changed we havent had any more tickets... obviously cause our car hasnt moved from the garden.


The cars pretty non descript and looks exactly like ours on the pcn pictures.



My issues really is how can it be that it goes to bailliffs withotu even telling us its gone to court and giving us chance to defend it and how do we now deal witht he baillifs.


Have just gone through email and found a London Tribunals appeal that i did for one of the other Redbridge tickets, this was upheld and no further action. This is a different ticket number. Im wondering if I didnt realise there were 2 seperate tickets with Redbridge?!?!?


If havent challenged this one... which could be the case, am I too late at this stage?

Did the Police give you an Incident Number, that you gave to Redbridge along with proof of your contact with the DVLA which caused them to agree to reissue a new VRN?
