County Court Business Centre Claim Form

Hi Guys,
Last week while I was away I received a County Court Business Centre Claim Form.
Issue Date 14/09/2018
Claimant: Bank Park Management LTD
Address for Sending documents: QDR Solicitors Limited
Particulars of claim:
The Claimants claim is for an outstanding parking charge issued to the vehicle (Myreg) when parked at THE FARLEY CENTRE WEST BROMWICH B70 7QU. The site is managed by the claimant. The Defendant is the keeper of or the driver named in accordance with schedule 4 of Protection of Freedom Act 2012 of the vehicle. Vehicles parking at the site are subject to the parking restrictions and terms and conditions which are set out on signs at the site and form part of a contract between the driver of the vehicle and the claimant. on 07 08 2017, the vehicle was parked at the site in breach of the contract, the contravention being ANPR failure to pay for parking. By entering this contract the defendant agreed they would be liable for £100.00 parking charges incured by the claimant for the collection of the debt pursuant to the terms and conditions.
It is then signed by: QDR Solicitors Limited
I admit I was at fault here, the machine wasn't working so I thought it didn't apply in the evening so I carried on thinking nothing of it. I have received letters over the past year and just ignored them, which as I've been reading was the wrong thing to do, my bad. I was told it was a scam by peers and to ignore them that nothing would come of it, which clearly is wrong.
I've read through the forums and answered the MCOL? I denied the entire claim today and now need to ready my defense. I've read through the forums for something to base my defense on but I'm a biff at stuff like this and I don't know what points to string together.
Any advice guys? If not I guess i'll have to hold my hands up and pay.

read some of the recent 2018 BARGEPOLE defences and see what you come up with
until you post a propsal for your defence, it wont get looked at

Have you perhaps done the Acknowledgement of Service?
With a Claim Issue Date of 14th September, you have until Wednesday 3rd October to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.
Having done the AoS, you then have until 4pm on Wednesday 17th October 2018 to file your Defence.
That's over three weeks away. Plenty of time to hone the Defence to perfection.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for the Directions Questionnaire and come back here.0 -
