Mortgage provider consent to amend title deeds

Hi all

I initially posted a query in the LR thread, things have moved on slightly since then so wanted to canvas opinion a little.

In short: I'm selling my house, it has come to light some rights were missing from my deeds. My solicitor has applied to the land registry to correct the title deeds.

We have had a written response from the LR that they have requested permission from my mortgage lender to amend the title which must be standard practice. The sale has already dragged on for months, but they say if they don't hear from my mortgage company within 3 weeks they will change the title without needing their consent, or earlier if they get a positive response.

I think I have a couple of options here:

1. I'm really keen to speed up the process as this is jeopardising the chain. I'd like to contact my mortgage provider to request an immediate response. If I do this I guess there is a small chance they might challenge the request and I'll have highlighted it to them, missing the opportunity for it to slip under their radar.

Or

2. If I keep quiet and let the process run for three weeks I'm thinking it's possible the mortgage company may not have even seen/processed the request in that time and I'll automatically be approved.

Does anyone have any experience in amending a title and how often a mortgage lender would challenge this? In my case I'm adding rights to match our adjoining neighbours title giving us both permission to use the shared driveway and drainage.

I can't imagine the mortgage company would question this, in fact I'd see it as a positive in terms of saleability, so I'm leaning towards option 1 to try to get a resolution as quickly as possible save the chain.
