    HMRC/VAT are no longer a preferred creditor, that changed with the Enterprise Act 2002.

    Unpaid wages, redundancy payments etc are met by a government fund if the employer goes bust and can't meet these. See https://www.gov.uk/your-rights-if-your-employer-is-insolvent

    Only if I had somewhere better to go. Local authorities often run assertion training courses - usually no more than one or two days and at relatively modest cost.
  • I think you need to break down the elements a bit here as you are conflating different things.

    - You are well paid and get a company car. You are often asked to work additional hours. You need to check what is normal in the type of job you do - additional hours often are, and are often unpaid. But this varies by industry and job type.

    - You are working on a Saturday which should be paid but often they 'forget'. Don't let them. This differs from the issue above. Don't be soft on this - make sure you get paid what you are entitled to.

    - the company pays late due to cashflow problems. Make a fuss - make sure you are not last in line. At the moment you are a soft touch.

    - You think the company can't survive without you. No problem - they offer shares or long term retention incentives. If they don't then they don't consider you indispensable. You can leave. If you resign a new deal may be forthcoming.

    - Your employer might have serious cash problems. Its better to look for work now then when its desperate. If they don't pay your final salary then write back on here and someone can tell you what to do. Also keep records of any amounts underpaid and make sure you are claiming for these.
  • thanks for all the advice everyone. after much deliberation and anxiety ive decided I need to hand my notice in this week. I have been paid too erratically for too long and cant manage my finances properly. I have had a job offer for the same wage just without the company car. I figure I will work the designated notice period even though I am owed £6580 in 2 months unpaid wages. I am doing this just to remain professional throughout the whole ordeal.

    It isn't your company so it's up to the person who owns it to ensure that customers get the service they should. Tell him straight that you will not do one minute more overtime until all the pay you are owed is received. You are being taken for a total mug and you are letting him get away with it.
    If you were truly valued you wouldn't be treated that way.

    Don't allow yourself to be talked out of it. Alongside your notice you might want to hand him a letter before action giving him 28 days to settle the amount owed or else you will begin legal proceedings to recover the money. I'd recommend an employment tribunal rather than small claims if you qualify, because if he doesn't pay there is slightly more chance of recovering at least some of what you are owed. If you are really "lucky" he'll dismiss got on the spot and then you can claim unfair dismissal as well :) Make sure got have trustworthy witnesses and/ or your phone accidentally recording everything.....
  • thanks, I just have to be strong and make damn sure I dont crack if he tries to talk me out of it. I will check the eligibility for employment tribunals cheers
  • Do you have a contract? Check what it says about payment of salary. A standard contract will state the date of salary payment each month.

    If it were me I would be downloading a programme called ACR on to my phone and have my phone recording the interview where you give notice. I'm not suggesting that you do anything with this recording except use it as an aide-memoire for YOURSELF as to what was said in the interview - you may well find it useful when you stick to your guns, resign, and then feel regretful afterwards. Feel regretful until you play yourself the recording, that is.....
