Problem with Right to Manage joint Director

We have an awful problem with the above.

Long story short we were being bled dry by managing agents and went down the RTM route. Only 2 of us were around and at the time we couldn't trace the third flat owner ( its a BTL and the tenant wouldn't give us an address )

So the two of us did the RTM and here is the problem. I have realised the other director has severe mental health problems which are becoming worse, when I first met him I though him odd and uneducated but nothing on the scale that has become apparent.

It transpires he has been sectioned over the summer and is now back in the flat but he is starting to help himself to the service charge funds, dipping in with his cash card, claiming strangers are damaging his property and he needs to repair it, the one today has been that they have blocked his toilet. and if I don't respond he will take my flat. spouting rubbish really. I also regularly get threats so have blocked him on my phone but he can still leave disgusting voicemails.

We have now traced the third flat owner and want to get him on as a director and this other man off of the directorship . We have literally just decided this and haven't done much research but there is a lot of knowledge here and wondered if anyone has any experience of this.

We cant having him helping himself to service charge funds and he has no receipts because the expenditure isn't genuine and he takes the money because he isn't working and is broke.

Many thanks

How does he have a cash card? Does all expenditure not need all signatories... like a cheque?
  • No the account came with cash cards and when it was set up it was either signature.

I need to find out if I can get him off the RTM company and add the other flat owner or if all else fails dissolve this one and set up a new one with myself and the other flat owner.

The whole thing should have been so workable and now we are in this situation.
